I think it's time we make a Michigan open carry legality quiz that can be taken online.

It seems like many people here don't know the laws and other idiosyncrasies as well as they should. Even someone like me who's been involved in open carrying for a while learns new facts every now and then.

So with that in mind, I think we should set up a detailed multiple choice quiz. Long time OCers could use it just to make sure they are up to date, and new comers could make sure they've done their home work properly. It could also encompass concealed carry laws as well.

To make sure I'm being clear, here are some examples of potential questions.

Which of the following places can a non CPL holder open carry in?
A- A moving car
B- A Marathon gas station
C- A Starbucks coffee shop
D- A church

Where may a CPL holder NOT open carry?
A- A court house
B- National parks
C- A post office
D- All of the above are generally illegal.
E- Any of the above are pre empted by Michigan State law, and are legal to carry on, concealed or otherwise, if you have a CPL

Which of the following are among the suitable options for open carrying without a CPL, or as a CPL holder carrying in one of the gun free zones?
A- A Serpa paddle holster with a t shirt tucked over part of the grip
B- A flap holster that covers almost the entire gun
C- A Bianchi IWB holster
D- A drop leg holster
E- A and D only

When is it legal to record a conversation in Michigan?
A- When both parties know
B- When at least one party knows
C- Any time and for any reason
D- B and C only
E- None of the above

Which of the following is a legal action while in possession of a firearm on school property?
A- An 18 year old high school senior leaving his trigger locked, cased, and unloaded shotgun in his trunk so he can go hunt deer after school gets out
B- A CPL holder carrying concealed as he drops his daughter off at elementary school
C- A non CPL holder open carrying on a sunday afternoon while sitting on a bench in front of a middle school.
D- A CPL holder open carrying to a school football game
E- B and D only.

I want to do 2 things with this. First, get the help of everyone here writing out the toughest, most relevant questions we can come up with. Having everyone participate will be a good way to insure variety in question styles. I want lots of questions, as in as many as it takes to cover everything we know of that open carriers must know. Make sure they're as hard as possible, and very specific. We can provide written explanations for each question so that when people answer them wrong, they can quickly and easily see why.

We could even maybe have a couple different test versions if we wanted. Then, I want to use whatever service is handy to put the test(s) online. If someone is good with that, perfect. Otherwise I can figure it out.

If MOC wishes to officially get behind this quiz concept, obviously final versions(s) would have to be approved by the committee.

So type your suggested questions out, and I'll compile them. Thanks in advance to anyone who wants to help.

Spectacular! Thank you.

I'm writing some more out right now, but as I said before, I encourage everyone to write their own out too.

C- When an officer sees you and stops you while you're open carrying in a liquor licensed establishment

B- Driving from your apartment or house to a public parking structure, with your unloaded pistol securely locked in your trunk, for the purpose of going to a MOC meeting
C- Transporting a cased handgun in your trunk, with loaded magazines separate from the handgun, but in the same container as the handgun itself.
D- All of the above are illegal in Michigan

(10)- Several OC’ers are talking about carrying to movie theaters. Who is right?
A- OC’er A says that you can open carry at a theater without a CPL, but you must be careful about where you park, because of the transportation rules.
B- OC’er B says that you can open carry to a theater with or without a CPL, because no alcohol is sold there
C- OC’er C says that concealed or open carry is fine, but you must have a CPL.
D- A and C only are correct

(11)-At a MOC meeting, the topic of Federally owned land comes up. Who is right?
A- OC’er A says that with or without a CPL, you may loaded open carry in Federal Land.
B- OC’er B says that you may target shoot at safe back stops on Federal land.
C- OC’er C says that you can only be in possession of a firearm in National Forests in designated hunting areas, during designated hunting seasons.
D- All of the above are true
E- None of the above are true

(12)- Which of the following is true about Michigan state land and state parks?
A- You may only carry a loaded firearm in a state park if you are hunting, or a CPL holder carrying a pistol. In all other situations, firearms must be unloaded in the barrel and magazine
B- Any safe back stop on state land may be used for target shooting, however only during daylight hours, and never during bow season.
C- Some state parks have shooting ranges where you have to pay, others are free.

(13)- At a MOC meeting, 4 open carriers are discussing carrying in banks. Who is right?
A- OC’er A says that according to Michigan law, you can OC or CC at a bank, but you must have a CPL
B- OC’er B says that because most banks are controlled by the federal government, carry by anyone other than sworn federal officers is prohibited in most circumstances.
C- OC’er C says that carrying at financial institutions is not statutorily prohibited by Michigan law, so anyone may open carry there, but you could alarm bank employees, and have the police called.
D- OC’er D says that you should always avoid open carrying in banks, because people will think you could be a robber, and the police might shoot you.

(14)- Which of the following is protected and ensured by the Bill Of Rights?
A- You have an absolute right to remain silent, to avoid self incrimination.
B- It’s a constitutional obligation of able bodied adults to be armed, to protect the security of their free states

D- All of the above are true.

(15)- A pastor wants to carry his pistol to his church, and encourage everyone who attends to do the same if they own pistols.
A- He can’t, nor can any members of his church, because Michigan law disallows carry at churches.
B- As the owner of the church property, he has the right to supersede state law, and allow OC by non CPL holders, and CC/OC by those with CPLs
C- Because wine is served on some Sundays, the Michigan liquor control act comes into play, and it is illegal for anyone other than police who are not drinking to possess firearms in the church.
D- A and C only

(16)- A group of OC’ers are discussing the gun shows that used to take place at the Pontiac Silverdome. Who is correct?
A- OCer A says that it was a bad place to host the shows, because it’s illegal to carry there at all, because sports arenas are gun free zones.
B- OCer B says that the owner of the Silverdome was able to bypass state law by giving his specific permission to possess firearms there.
C- OCer C says that you can open carry in any of the gun free zones as long as you have a CPL, so the Silverdome would have had no authority to kick anyone out.
D- OCer D says that private property owners have the right to kick anyone out whenever they please, so if the Silverdome said no loaded firearms, you could get charged with trespassing if you disobeyed the request.

(17)- Several OCers are talking about liquor license holding businesses, and where they can carry. Who is correct?
A- OC’er A says that you can’t carry at a bar even if you do have a CPL, because bars are gun free zones
B- OCer B says that anyone, whether they have a CPL or not, can open carry at a liquor licensed business, as long as they make less than 50% of their income from alcohol sales.
C- OCer C says that the easiest way to remember it is that you can’t carry at ANY liquor licensed business if you don’t have a CPL, and if you do have a CPL, the best way to ensure legal compliance is to open carry at the locations that serve alcohol for onsite consumption.
D-OCer D says that if you’re going to have even a small amount of alcohol, that your gun should be locked in the trunk, with the ammunition stored separately from the firearm.

(18)- You are OCing. You have been stopped by a city police officer. He says that you are being detained, and you must talk to him because you are being investigated. He asks you where you are headed, and how you got to where you are now. What should you do?
A- Tell him you’re not talking to him, and you want to see your lawyer
B-Ask what crime he suspects you of committing
C- Suggest that he calls the prosecutor to brush up on Michigan law, and the Bill Of Rights
D- Any of these, but DON’T answer his questions if he’s on a fishing expedition to incriminate you.

(19)- Preemption in Michigan nullifies which of the following types of regulations?
A- City ordinances
B- Federal laws that unjustly regulate inner state activities.
C- City and state laws regarding knives and pepper spray, but only if you’ve got a CPL.
D- State and city laws against transporting loaded long guns in the passenger compartment of a vehicle, but only for CPL holders.

(20)- An OCer wants to take his 16 year old son with him to an open carry event at a McDonalds, and he wants to let him carry one of his pistols.
A- He can't, it would be a felony to let him borrow a hand gun that isn't his.
B- He can let him carry, but he must be in the immediate area at all times.
C- The law only allows someone under 18 to be in possession of a pistol while hunting or target shooting, and always with the direct supervision of the pistols owner.
D- None of the above are true.

(21)- An OCer has a Colt 1878 revolver in .45 Colt caliber. It was made well before 1899, and it can ONLY use black powder cartridges. Which of the following is/are true?
A-Unlike most black powder handguns, it must be registered, because it uses cartridges
B- No permit is required to carry it, concealed or otherwise, because Federal and State law don't consider it a firearm.
C- If it doesn't have a serial number, one must be stamped into it so that it can be registered.

(22)- An OCer has a NFA registered Mac 11, but he has no CPL. May he open carry it?
A- Federal law specifically prohibits transportation or possession of NFA weapons unless at or on the way to work, home,a place of repair, or a shooting range. But there is an exemption for CPL holders.
B- Michigan law considers it a pistol, and assuming allFederal laws are complied with, he may carryit under the restrictions of Michigan laws concerningpistols.
C- Because Federal Firearms Licenses are required to own machine guns, hedoesn't need to worry, because his FFL supersedes state law, and he may carry it almostanywhere he chooses to, concealed or openly.

(23)- A CPL holder wants to carry a loaded shotgun in the front seat of his car. Does Michigan allow this?
A- This is legal with a CPL, but only if it’s unloaded in the barrel and Magazine
B- Yes, but it must be defined as a pistol by Michigan law, with an overall length of 26-30”, and it must be registered as a pistol as well.
C- Michigan law ONLY allows pistols in the passenger compartment of a car, and bans sawed off shotguns, which are the only shotguns with pistol dimensions, so shotguns in the passenger compartment are illegal.
D- Long guns over 30" can be stored within reach of the passengers of a car, but they must be unloaded and encased.

(24)- Which of the following are locations which are illegal for a CPL holder to open carry in?
A-The State Capitol building, Police Stations, and City Hall
B- K-12 Schools, state run colleges, and any vocational training schools
C- Restaurants that serve alcohol for onsite consumption, bars, and taverns
D- Banks, Credit Unions, theaters and sports arenas
E- None of the above. Having a CPL in Michigan gives you more rights to carry than almost any other state in the country offers.

(25)- An OCer enjoys riding motorcycles and bicycles. He has no CPL. May he open carry on either?
A-It appears to be legal, but the law doesn’t define it as well as it should, so he would risk being criminally charged if he did it. It is completely non advisable as of this writing.
B- By Michigan law, a gun is magically concealed as soon as you mount a bicycle or motorcycle, and therefore he must have a CPL to OC on his bikes.
C- Only an idiot could think that an openly holstered pistol is concealed if it’s worn by a cyclist, that is why open carry on bikes of all types is preemptively legal by state law.

(26)- A would be open carrier who doesn’t have a CPL despises the idea that he must register a pistol in Michigan, but he still wants to open carry a handgun. This has made him interested in Black powder revolvers.
A- He can purchase a cap and ball black powder revolver over the counter, without so much as showing ID
B- If he gets a black powder revolver he won’t have the “license to carry” granted by the Michigan registration process, so he’d have to worry about federal school zones
C- The Black powder revolver couldn’t have a cartridge conversion cylinder; otherwise it would legally have to be registered.
D- Carrying black powder revolvers still requires compliance with all Michigan laws regarding pistol possession, the only exemptions in state and federal law are for purchasing and registration requirements.
E- All of the above

(27)- You are a CPL holder. You are coming back from the shooting range. You are legally transporting rifles, pistols, and shotguns in your trunk. You have no weapons in the passenger compartment of the car at all, not even a swiss army knife. You get pulled over for whatever reason. In regards to disclosure of the gunsto the officer who stops you, which of the following is/are true?

A- You must disclose immediately that you are carrying those firearms, but only if you have a CPL.

B- Sincenone of the firearms are being carried under the authority of the CPL, it's not the cops business to know they are in the trunk, and you have no obligation to tellhim.

C- Because of the LEIN system, the cop will know you are a CPL holder before he even gets out of his car to talk to you, and will possiblyget madif you don't tell him you are a CPL holder. Youmight be improperly cited for failure to disclose because of this, but it is a charge that would be dropped, because it would be invalid.

D- Michigan state law doesn't require disclosure of the unloadedfirearms stored properly in the trunk, but the 1986 Firearm Owners Protection Act has a compromise stipulation in it that you must disclose the firearms in your trunk if you are detained by a federal officer.

E- B, C, and D only.

The recording question isn't quite right.

I thought that in order to record, a "reasonable person" should have no expectation of privacy in the place which the recording happened, and that's the only requirement. (In other words, if it's not a public place, than both parties must know).

I'll see if I can edit it, but remember, it's all rough, and I make no guarantees that any of it makes any sense at all. So any questions that anyone disagrees with, please write them out your way and post them. That way, we can use all the best ones.

I think that this idea is beyond wonderful! It will be a great tool for us all to become familiar (or to stay familiar) with the information we need to know as OCers. Some of these questions are really tough for me even though I thought I had an excellent grasp on the OC laws. Detailed explanations for each answer (as well as citations of the law) will also play an integral part in helping people learn and understand the material.

+1 for OC quizzes! :D

I think this is a great idea.

We see a number of people, not just in Michigan, who seem to dive into OC without informing themselves of the law or their rights to the extent that is wise.

I suspect part of the problem is that they fail to estimate the possible pitfalls.

Questions to which they do not know the answer really helps highlight that there is more to know.

If we can get 10-15 questions from some of the more knowledgeable members, posted on this thread I'll make up the game. Whether or not you provide me with the answers is your choice. I'll have to learn it all somehow anyways.

Looking forward to getting this made:celebrate

Hm, If i had to venture a guess, either a rapier or a falchion. Rapiers, were the weapon of the nobility of the time. The falchion IMO, was the forerunner to the cutlass, which is the sword most of us picture someone carrying on a wooden ship.

So...Rapier? (And the explorer is Christopher Columbus, who sailed for the Spanish, who hired him to help keep against the Portuguese, Woo hoo Grade school History :celebrate)

I think this is a great idea... it helps those that feel the "stickies" contain too much information. They can use it as a sort of "review" (plus more) of what they should have gotten out of it.

BTW, the first question, in order to be grammatically correct, should read:

1- In which of the following places can a non CPL holder "open-carry"?
A- A moving car
B- A Marathon gas station
C- A Starbucks coffee shop
D- A church

I don't claim that I am the end-all grammarian nor that we should spend our time worrying about such things in most posts. However, since something like this may be instrumental in the initial impression that a new person develops of us, these questions should be written very carefully.
