THIS BILL VIOLATES THE U.S. Constitution’s 2[sup]nd[/sup], 4[sup]th[/sup] and 5[sup]th[/sup] amendments that We the People wrote.

2[sup]nd[/sup] amendment A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed

4[sup]th[/sup] amendment The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

To increase public safety and reduce the threat to domestic security by including persons who may be prevented from boarding an aircraft in the National Instant Criminal Background Check System, and for other purposes.


Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the `No Fly, No Buy Act of 2009'.

SEC. 2. INCLUSION OF PERSONS WHO MAY BE PREVENTED FROM BOARDING AN AIRCRAFT IN THE NATIONAL INSTANT CRIMINAL BACKGROUND CHECK SYSTEM.

(a) In General- Section 103(f) of the Brady Handgun Violence Prevention Act (18 U.S.C. 922 note) is amended by inserting `, notwithstanding any regulation prescribed under section 40119(b) of title 49, United States Code' before the period.

(b) Transfer or Other Disposition of Firearm to Such Persons- Section 922(d) of title 18, United States Code, is amended--

(1) by striking `or' at the end of paragraph (8);

(2) by striking the period at the end of paragraph (9) and inserting `; or'; and

(3) by inserting after paragraph (9) the following:

`(10) is an individual who is required, under regulations prescribed under section 114(h) of title 49, United States Code, to be prevented from boarding an aircraft.'.

(c) Shipment, Transport, Possession, or Receipt of Firearm by Such Persons- Section 922(g) of title 18, United States Code, is amended--

(1) by striking `or' at the end of paragraph (8);

(2) by striking the comma at the end of paragraph (9) and inserting `; or'; and

(3) by inserting after paragraph (9) the following:

`(10) who is an individual who is required, under regulations prescribed under section 114(h) of title 49, United States Code, to be prevented from boarding an aircraft,'.

H.R. 2401 Needs BURIED in your Committee - Forever

This totally-misguided proposed bill fails muster for several reasons:

(1) The "No Fly" list itself is buried in secrecy, in-accuracy and fails to follow even the pretense of "due process" regarding those whose names are put on it.

It is impossible to find out if you're on it, why you're on it or how to correct it if your name is there erroneously.

The "No Fly" list contains in-accurate, out-dated information, duplications, many "generic" names and a lot of the names on there are names that have NOTHING to do with suspected "terrorists".

The inclusion of such a pitifully-inadequate list into the NICS database would be a horrible travesty of justice.

This is nothing more than yet another attempt by a gun-grabbing "Representative" from New York to inhibit the lawful, God-given, Constitutionally-guaranteed right of legitimate, law-abiding Americans to purchase guns.

I ask you to both consider and uphold your Oath of Office: “I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God.”

This proposed bill is UN-Constitutional on its' face by any measure you care to name.

Kill it and bury it in your Committee - because it's the right thing to do. Thank you.

This bill has got to never see the light of day - or the House or Senate floor. It has the potential for being more damaging than nearly every other bill extant by enabling the denial of a weapons purchase by any 2nd Amendment activist or proponent - simply by having their name added to a "list".

The 'No Fly" list needs to be dumped in the first place. Nobody is going to be able to highjack another airliner after what happened on 9/11. Even unruly and obnoxiouspassengers are taken down and detained by other passengers, now. I can't imagine anyone not being ripped to shreds if they attampted to take over another plane.

I hope people realize that a bill - even if it is "in Committee" is still a very potent latent threat.

A co-ordinated, well-timed effort on the part of the "sponsor" could (especially if backed by the anti-gun faction of the Administration) come zipping out of Committee and up for a vote when the regular "pro"-gun Representatives have already left for the day (or the weekend) - a situation where a simple majority vote of those present in the Chamber at that time, or a "quorum", could blind-side everyone with a surprise passage of such a bill.

Not only does contacting the specific Committee members help give them pause for trying such a stunt, but it let's them see (by hearing from people other than their own constituents) exactly how broad-based the opposition is - and how many people are watching their actions.

And that's a GOOD thing. Pete
