Since the burglar wasn't armed, now you have to go through the "was it a legal shoot" exercise with the District Attorney and Police. It's one thing to think you are in danger and shoot, another for them to agree that a reasonable person in the same situation would have done it.I don't think he's out of the woods yet, but hopefully he will be soon.

I don't know how the law is in Virginia but a suspect being unarmed is not necessarily a factor in regards to the law in Georgia when it comes to legal justification for killing a person. As long as your life or another's is in danger or the suspect is committing a forcible felony then their lack of a weapon does not matter.

If it ever went to trial I'm sure he'd win his case, assuming new information does not paint him in a different light. Rural area, slow police response, with his wife, his store being robbed, and suspect has past record, that stacks pretty well in his favor.
