So yeah I went to get this glock 35 today that i found at the PX on base and got denied thanks to the wonderful communistwealth of Virginia and trying to charge my wife and I for child neglect because our daughter got sick and we didn't take her to the hospital and Walter reed army hospital couldn't find anything wrong with her( kinda hard to find somethin wrong when you refuse to do any tests).



But so now I have to wait until after november until I can get a new pistol although after they filed charges they issued my wife her CHP and they have yet to revoke them and I was told that I am legally allowed to keep and bear arms still. I love how these people with social services and cps think they are above the constitution.

Hopefully come november I can find another 35 and 27 for the same decent price and take these people jobs since now I can purchase firearms and my career in the USMC was destroyed.

Sorry bout the rant kinda a bad day today. But Oc'd at walmart in dumfries on rte 1 no problems that was the only thing that wasn't crappy.

So let me get this straight.

You were never charged (You said TRYING to charge), never convicted, she has a CHP, and you still could not purchase?

Sounds fishy to me.

Thinking logically (I know), if you have not been to court, then I may understand. But if not convicted, nor waiting a court date, there should be no hold up.

Do you have a CHP?

If you cannot purchase guns right now, how come they have not taken your weapons that you own?

I am just trying to understand.

Yes we both have our CHP. We were direct indicted which is where they just go to a grand jury and dont tell you about it. Then they showed up and arrested us last month and that is how we found out about it since originally the CA's office said they weren't going to file charges. When I went to fill out the background check for BATFE I noticed something on there about if you're under idicitment(spelling) for a felony where the judge could sentence you to more then 1 yr of imprisonment which I miss read it I guess or I'm just so used to marking no to all of the questions that I din't really pay attention. When the guy ran the check he said it was delayed for probally an hour so I was like f**k the whole charges being filed against us is going to get me denied. Which I thought it was only if you have been convicted.

But I was told the only way I will lose my CHP is if I'm convicted and then well my wife got her CHP approved even after all of the charges were filed. So I just assumed that since I could still KEEP AND BEAR ARMS openly or concealed I was able to legaly aquire them. Hopefully it's not a p.i.t.a to get it fixed once they lose the trail since they have nothin on me since I was out in the field doing as I was told to by the US Goverment during the time that my daughter became ill. But hey CPS is allowed to falsify reports and can get people to say what ever they want them to say like right now supposedly there is a doc that is gunna say my wife intentionally starved my daughter and that is why she lost weight.



once again sorry for the long post once I mention all of this I get pissed at this s**t and keep going and going.

Dude, I've been "delayed" for almost 48 hours before. It's no big deal. They're just processing a s**t-ton of applications.

Unless I'm misreading your post. It doesn't sound, from your second post, that you were denied, just delayed.

Your syntax leaves a little to be desired.;)

Ok so I might still be able to pass it? I didn't know you could get delayed that long and I just figured since they had the question on the BATFE form that I would've probally been denied and that was causing the delay. Sorry bout the piss poor grammer that is one of my weak areas I suck at trying to figure out where the periods or commas or new paragraphs go for some reason. I used to be a great writer and be gramatically correct and well now I couldn't write a proper paper to save my life.



Well hopefully then the guncounter calls me tomorrow to tell me I can pick it up. Thanks for the input.

If you have a pending felony indictment a judge may, but doesn't have to, "suspend" your CHP (mine was "revoked" which is beyond the authority granted by the statute). And in addition you will be blocked from purchasing new guns through dealers. I am NOT sure but you may be able to still purchase privately but I do not know that for sure. I haven't bothered to find out since I don't have money to spend on guns at the moment.

They cannot take your gun rights to own or carry away until after due process when you are found guilty. Which I really don't understand since to keep and bear implies buying. I might understand it if there was evidence that you were an immediate threat or something. Also if you are found guilty of a felony that was non-violent why are you losing your rights to arms? To me you should keep you rights unless you abuse those rights. I still carry, in fact the cop that came to get my CHP said it wouldn't matter anyway since he knew I OCed all the time :^)....

BTW, the case is looking REALLY GOOD :^).

In VA I believe that if they haven't heard back in 72 hours they'll sell it to you anyway?

I forget the rules exactly, but delays are VERY typical. If you have a common name or decline to provide your SSN (which is optional, but I've been advised it can hold up approval) or any number of other things.

Are you a recent transplant to VA? If you have a pending case or NO VA HISTORY that might also hold you up. I wouldn't worry about it unless they DENY your application. Until it is denied, it is simply delayed.

I have been delayed at least 24 hours for every single purchase I've ever made. Ever. And I'm a lifetime VA resident.

...And I was disturbed when mine was delayed a few hours. I thought I had done something wrong that I didn't know about. I hadn't purchased a weapon since I got a Ruger P-90 in Texas around 2000. I was buying a Romanian AK (WASR 10/63) and an H&K USP 45 at the Marine Corps Exchange in Norfolk and was told my paperwork was "delayed" and they would call me back when it went through. I came back a couple hours later and they said it still hadn't come back yet. Since I lived an hour away, and I didn't want to play in afternoon rush-hour traffic through the tunnel, I tol them I would just go home and come back the next day. When I came back the next morning, the guy told me it came through shortly after I had left the day before.

When I bought midget's G-21SF from the @$$hole from Sunshine whatever from richmond, it was a little over a month later at the Hampton Gun Show. I know they were busy, but I only had to wait about 2 hours for the paperwork to come back.

Next purchase will be a match-grade AR if they haven't been banned yet...

I hate the damned DSS and the CPS. They're a bunch of neo-Nazis who get off on power trips and serve very little real positions in life. How DID we get along without them for most of our existence??? Bunch of socialist commie maggots.

Sounds like you may have been delayed vice denied. Call the PX and see if the approval has come through.

Check the FBI website:

It is recommended the FFL record the date provided in the delay response on which the firearm may be lawfully transferred under federal law if a final determination of proceed or denied is not received from the NICS.

Cases wherethe denialmay apply in your instance are:

Persons who are fugitives of justice—for example, the subject of an active felony or misdemeanor warrant.

OR

A person who is under indictment or information for a crime punishable by imprisonment for a term exceeding one year.

Finally, if you don't have a lawyer to represent you on the child neglect charges, GET ONE NOW. Forget about buying the firearm. Your most important expense will be fighting these charges by the Commonwealth. You have too muchto loseon this.

No we aren't new to Va we've been here for almost two years now. Today I tried calling them and they haven't heard back so hopefully tomorrow I might here from them if not I'll call again. We both have lawyers since the CA demanded we have seperate lawyers which they are making it seem like they are going to try to get one of to testify against the other one for a lesser charge or immunity but it will be a cold day in hell before either of us do that.



As far as DSS and CPS go southernboy don't even get me started on that. They are the most corrupt people ever our case worker came into our house to meet with us and decided that it was ok to sit there and insult my wife saying how she is a horrible Marine wife and mother and how she is my personal servent for the most part. Which if it wasn't for the fact that she has the power to take my kids from us again we have to just take her BS for now.



I don't wanna sound like one of them people that wrap foil on their heads and all. But I swear they listen in on phone calls since they have brought stuff up in meetings that I have only said to my mom or sister on the phone. Also weirdly enough excatly a week prior to us having charges filed against us I was trying to get my brother in law's sister's # to get in contact with one of her lawyer friends to start a federal lawsuit against them since all of this was almost over then all of a sudden we a little over week later we have 3 PWCPD officer knocking on our door with an arrest warrant for us. I also tried to get a federal investigation since they had my daughter down as living in the foster home still even though we have had her back since april and they caught wind of that and all of a suddne did the paper work and put down that she has been living with us since april. So i can't get them for defrauding the US goverment since they receive federal funds for having kids in foster care.



Now I have to go to court friday since the CA is demanding that my wife and myself be tried together but oh well either waqy works for me and if they get that then I get this done sooner. Once this is done I'm going after them financially and will teach them what happens when you mess with a very pissed of Marine Grunt and his family especially when they act like me being in the Marines as a grunt, being deployed to Afghanistan and Iraq and being seriously injured in Iraq makes me a hoorible parent. Ok Rant over for now.

One other thing has any one ever been told that if you don't put your ssn on the State Police form you have to put your DL number? I'm just wondering cause I never put it on the form when I buy from VA arms and they have never said anything. But the guy at the gun counter said that was the VA law and I didn't feel like arguing with him since most of the people that work there have no need to be selling guns but thats a whole other story.

I didn't think it was required, but it is recommended. I never put my SSN on anything - I argue it every time (unless it's pay-related, they have no need for it). I do sometimes provide my DL, though.

It helps that there are probably only two adults with our last name in the whole state, of course (I think there are less than 200 nation-wide - most of whom we know).

I wonder if a smart lawyer, or even a lawyer of average intelligence, would tell his client he should NOT be posting any of this stuff on the internet until the case is completely settled.

Huh? There's something called due process, and the right to face your accuser. If you don't have a lawyer, get one. If you have one, get a better one.

that was all with our old lawyer who was never told about the grand jury he found out when I called him to let him know we were about to be arrested. It sure would have been nice to be able to be at the Grand Jury so we could have defended our selves there and not have to go through all this and then maybe I would still be able to salvage my career. I'm assuming that because of this when I go to apply for border patrol it's probally going to affect this, but I still have to try to get ahold of the recruiter and find out.
