RCW 9.41.270...a 2X4...baseball bat...your fists?

could you OC or CC every day items, including your fists, and be found guilty of a violation this statuate?

im thinkin that if you open your coat to show a BG that you have a "rolling pin hidden on you", to scare him away from his threatening manner, you may be guilty! im sure we can all agree that showing a gun would be a violation, unless you were actually protecting yourself from an attack!

The RCW explains that it is unlawful to carry or handle in a manner, under circumstances, and at a time and place that either manifests an intent to intimidate another or that warrants an alarm for the safety of others. Obviously your fist is a body part. Using them with an intent to intimidate would be to act like you're going to punch someone.

A person can legally carry a baseball bat around if they're not using it with an intent to intimidate. Such an intent could be looked at as something such as swinging it at objects with others around while yelling, or walking up to someone and doing a half swing on them. The key words here are "Intent to intimidate or cause an alarm for safety of others"

Are there any cases of someone being prosecuted for weapon related crimes when they were just unarmed? A prosecutor might make the claims that someone trained in martial arts used unnecessary force (killing someone that is also unarmed), but I doubt they would make the claim that they used a weapon.
