Is it legal to transport a handgun to a family or friends house in VA? I am not a resident of VA but would like to bring the gun along just in case.

Thank you.

Yes you can under the 1986 Federal Firearms Owner's Protection Act. As long as you can legally own the gun in your home state and the state to which you are traveling, you may do this. Just make sure it is secured in a case in your trunk, unloaded, with ammunition stored separately.

You can even pass through Philadelphia, Maryland, and Washington, D.C. under this act's protections.

And when you cross the line into Virginia you can OC if you so desire. :celebrate

Be aware of the few restrictions: Court Houses, jails, post offices, secure area of airports, private property when asked not to, NPS land which includes some parkways to name a few.

The only legal way to carry in a restaurant that serves alcohol is OC.

Enjoy your visit.

As a point of information it has been reported in these pages that a law enforcement entity in Maryland (State Police, I think) has stated publicly that they will not honor the intent of this law, that instead they will arrest and indict anyone found carrying without a Maryland permit and require that they contest the charges by "proving" compliance with the FOPA.

It seems wise to not even stop in Maryland if possible.

(Yes, I know I should cite the thread this was in, I don't know how to and still get back here. I'll post anyway, give it a try, and edit if my search fu is sublime.)

Here's a thread that mentions the subject still searching for the real word http://opencarry.mywowbb.com/view_topic.php?id=29884&forum_id=54

I'm tired of Maryland and their crap. I think I'm just going to invade them in the morning when I get up... :)

I used to live in Bergen and worked in both Warren and Sussex.

I imagine that you're taking the bridge from P'burg into Easton or 84 West into Scranton and down to 81?

Take 81 down to 17 in Winchester, Va. Nice ride and it keeps you out of the People's Republic of Maryland for all but a few minutes.

I guess that means I need to find a good holster. I was going to bring an S&W 38 but I don't have a holster. I do have Fubus Holsters for my Glock, Beretta and 1911.

My sister lives in Roanoke and my parents are retiring there next year.

I visit at least once a year and I never noticed anyone open carrying before. When I was in AZ everyone was carrying and for some reason I felt safe everywhere I went. Even though I wasn't armed.

Does open carry mean I can have a loaded gun in my vehicle as long as its visible?

That is just crazy. Wouldn't that put Maryland in a very precarious position with not only a lawsuit from the victim but also one from the feds? Also, just refuse to allow them to search your car.

If that is true, I would welcome the gentle attention of the Maryland State Police.

I'd be delighted to return the favor. >=|

Black hawk makes a nice one for a 1911. If your going to open carry get a holster that has at least level II retention

Correct, as long as it is not "hidden from common observation". Loaded or unloaded is fine.

Good GRIEF, MAN!

What do you call an unloaded pistol?
A HAMMER!

"It ain't much good if it don't have bb's in it, right"?

On a more serious (and polite) note: Welcome to OC-FRIENDLY Virginia! Please OC and share your experiences with us when you can.

Edit:

Post Script: IF you can successfully escape the People's Republic of JerseyNew and navigate the treacherous waters (and highways) of Union of Socialist Counties of Maryland, Pull over at the first WELCOME TO VIRGINIA Welcome Center (if it is open due to budget cuts brought on by misappropriation of funds from Virginia Highways to ACORN) and put your holster (and pistol of choice) on and wear it proudly in the Birthplace of the Author of the Declaration of Independence, Thomas Jefferson.

Here's a pretty good source for info... http://www.virginia1774.org/Page1.html

"No freeman shall ever be debarred the use of arms."

I have family in fairly puvlic positions (teachers) in sussex, I'm sure you know them. I was born in clifton, but spent all my childhood summers in sussex/wantage. Enjoy your time in VA, it feels good to have rights.

I'd call an unloaded pistol "loaded" and not go swinging it around like a hammer. :)

An unloaded pistol suffers from PD... Projectile Dysfunction. :D
