Gun smugglers aided by U.S. yard-sale loophole
Last Updated: Tuesday, October 20, 2009 | 11:27 AM ET
CBC News

The origin of handguns smuggled into Canada from the U.S. is often impossible to track due to a U.S. loophole that lets dealers sell guns without any paperwork at garage sales, auctions and gun shows.

Once someone sells a gun through that type of a private transaction in the U.S., police can no longer follow its trail, said Ottawa Police Det. Chris Benson.

"'Cause there's no document and he hasn't broken the law," Benson said, "we can't trace that firearm beyond him and after he sells it. That could exchange hands 10 times before it's used in a crime and recovered and maybe make its way up to Canada."

Licensed dealers in the U.S. have to file paperwork about a buyer and have a legal obligation to report suspicious transactions, aiding police in investigations such as a double shooting at Pari's Motel in Ottawa on June 21, 2007, that killed 28-year-old Phillip Salmon and 32-year-old Ziad Ahmad.

Jury selection was continuing Tuesday for the trail of Kwaku Frimpong of Ottawa who was charged with first-degree murder in those deaths. Frimpong was 23 at the time of the shooting.
N.B. resident convicted of gun-running

U.S. databases and the paper trail created when the .40-caliber pistol used in that homicide was legitimately purchased at a store in Maine allowed police to trace the gun to 32-year-old New Brunswick resident Andrew Porter, who is currently serving time in the U.S. after pleading guilty to gun smuggling.

However, no forms or background checks are required in many states for private sales.

After such sales, even a serial number is not enough to reveal where the gun game from, Ottawa police say.

Investigators said they were able to reconstruct the path of the Pari's Motel gun and trace about 30 others imported through the same network because Porter obtained the guns legally. An accomplice in Maine would go to a legitimate gun store and buy 10 cheap handguns at a time, leaving a paper trail.

Lawrence Sears, a 63-year-old man who is serving jail time for purchasing guns for Porter, told CBC News that Porter used what locals called the "Milktown crossing," which is smaller than the main Calais-St Stephen border post and doesn't have an X-ray machine as the main crossing does. He also knew the customs officials well.

"He put 'em [the guns] under the seat and away he went to Canada with them," Sears said. "He knew what customs was on when he was going across the border."

Benson estimates that a cheap HiPoint handgun purchased new in the U.S. for $200 can fetch $1,000 to $2,000 in Canada, as their prices are marked up significantly due to their scarcity and illegality.

kind of like how drugs from south america go for so much in the US. maybe we should just take away everyones right to come to this country since there are those few who want to ruin it for everyone. that would make much more sense. cause its CLEARLY the drugs (and guns, cant forget those) fault cause it makes people do such terrible things, i say we just blame the country producing it... no wait, we'll SUE and PROTEST thatll show em!!!

Criminals is so stoopid. If I was going to smuggle guns into the Northern Autonomous Region, I would STEAL them, not have some loser who could later turn me in for leniency buy them for me. And: $2000 for a HiPoint? Imagine:

"Eh, if I robbed a bank I could afford to get a gun to - er, eh - rob a bank with so I could - eh - afford to get a gun". :banghead:

As we all know, once you make something illegal, all of the criminals stop doing it. And since it has been virtually impossible to legally own a handgun in Canada since 1935, I am forced to conclude that there are no illegal handguns in Canada.

So if I were to ever see someone carrying a handgun, I would be forced to conclude they are obeying the law, and not be concerned. Because criminals would never violate the law, right?

By the way, that detectiveis on crack if he thinks $2,000 is the street price for a HiPoint. $350, maybe $400 CDN at most. Or so I've heard, anyway. The 'bangersup here don't want HiPoints, they want Glocks so they can be like Fitty.

At least that's what I've heard.

Good grief, read the article.... (not directing that to anyone in particular, just everyone...)

Just like the anti's use the VT murders, they start the article with the fact that private sales' evil lack of traceability cripples the Law Enforcement community, then they proceed to detail how in the case of this double homicide, they were able to track the guns to the suspects and catch their accomplices as well.

Excuse me?

Then they go on to say they figured out how they were getting them into the country, using ... complicit, or perhaps socially engineered customs agents at the border.

They've solved the whole racket, and none of it involved private sales!

Yet they keep writing as if it does, and as if we won't notice the sham.

I propose we simply annex Canada and have done with it. All she does is criticize while squatting under our military umbrella.

I don't think that's a very good idea.

And please, don't paint all of us with the same brush. We aren't all effete anti-gun socialists.

Fun trivia: The United States imports more oil from Canada than Saudi Arabia:

Then there's the fresh water and lumber. We also tried to export Celine Dion to you, but for some odd reason, you guys sent her back.:cuss:

The author of the article is a little confused!

Maybe he is speaking of a private sale betweentwo interested parties and confusingthat legal transactionwith a Licensed FFL dealer requirements

Is the article meant to mislead? or is the author just a dumbass.

I have plans to drive the Al-Can highway to AK some year. But I will not be on the road without a way to defend myself against criminals and toothy critters alike.

What else is banned in most of Canada?? Radar Detectors!

I've heard drivers crossing the border into Canada are always asked if any firearms are on board. If one admits to that transgression, your property is confiscated. So, get ready to lie convincingly.

Dear Canadian statist authoritarian thugs,

We Americans don't care about your crime problem, or YOUR lack of control of your own borders, and what may pass through them. Stop your authoritarian statist whining about our laws. Our laws work just fine for us. They were not meant to control your criminals. Am I really having to explain this to you?

You cite a KNOWN failure within your OWN government to install an X-Ray machine to solve a KNOWN crossing weak point in your own border, and you have the gall to blame state laws in America? Really? hahahahahahaa!!!!

It's a given that this is just the latest authoritarian statist media ploy to control American firearms, so that our nations can merge as the collectivist North American Union. Sorry about your plans, but we have our own, and they don't involve you.

Solve your own border smuggling problems, install X-ray machines where they are needed, and stop the freaking whining. It's making my head hurt, and I get angry when my head hurts. :banghead:

Actually, since it was published in Canadian media, I don't think you were the intended audience. Maybe it's you who have mistaken them for someone who gives a damn. Not trying to pick a fight, just pointing it out.

I do like how the article is closed to commentary, though. Certainly wouldn't want us common folks to weigh in on what Statesman quite accurately described as "authoritarian statist whining."

I have to disagree. If the Canadian authoritarian statist media is whining about American gun freedom, I believe Americans are indeed the intended audience, and should speak up, since the intent of the article is to encourage state gun laws that restrict private sales in some way. They are stepping on our toes. Either way, they are going to hear it from me.

The Canadian article will be used by the authoritarian gun control statists here in the U.S., just as the Mexican authoritarian statist president whined about U.S. guns crossing his border (again, how is that our problem?). Immediately after that, anti-gun authoritarian statist Eric Holder decided to launch a media campaign to reinstate the so-called Assault Weapons Ban.

You see, the authoritarian statists in Canada, the U.S. and Mexico, are using statist media propaganda to incite panic in the U.S. population, and create a crisis where none should exist. Canada and Mexico needs to enforce their own blasted border laws, and leave the U.S. alone. I'm sick of this garbage!!!!

None of my diatribe is directed at the fine citizens of Canada, who own guns.
