Because, unfortunatly that would be in violation of Federal Law. It shouldn't be but it is. While he in all likely hood would not get caught, advocating breaking federal law on an open forum isnot a good idea. :)

Does anyone know if anyone has ever been prosecuted for violating this law under circumstances similar to those being discussed here? I cannot imagine it would be much of a priority matter for a US Atty, considering how many times I've had them turn down cases for federal prosecution where there were convicted felons, guns, and distribution quantities of drugs.

I tend to agree with Olypendrew. I havehad the occasion to arrest for manufacturing full auto parts for Uzi on Gov't property. The US atty said "No, have the local authorities handle it" The locals said "That's Federal we don't have jurisdiction"

That being said, do it right and be one of the good guys.

I'm DEFINITELY doing it all legal and legit like. Screwing that up will make them yank my CFP in a heartbeat and I'm gonna be honest... I like having protection (the non-latex kind) on me at all times!

It is a "straw purchase" regardless of the other person being a restricted person or not. If you use their money to buy a gun, it is illegal.
That last part is completely backwards. The law doesn't care one iota about what the purchaser's source of funds is. What matters is that the person who's presenting himself as doing the purchase, filling out the forms, etc, is actually the person who intends to own and possess the firearm.

And like others have said, though purchasing a firearm to make a gift of it to a non-prohibited person is completely legitimate, interstate transfer of firearms can be complicated...

youre still a good brother! just send him the money for everthing you want him to have!! he has to get his own CPL, if he wants one. he can buy his own gun at a shop 1st, and wait 3 days, or get the the CPL 1st, or he can find a private gun to buy from a person FTF with no waiting. All you need to do is give him the money, thats the gift part!

Depends on where in "Spokane" your brother lives. If he's in the City of Spokane, the permit will be issued by the Spokane Police Department. Out in the county or in any of the smaller incorporated cities I believe the Sheriff will issue the permit. May be a distinction without a difference since the Sheriff and SPD share the same headquarters building. In any event, as others have said there are no training requirements. You pays your money, gives your fingerprints and waits for the permit.

If you decide to transfer through an FFL, All American Arms on E. Sprague charges $25 plus tax ($2.18) to do a transfer. I imagine most of the other dealers in town will charge about the same. I have no employment or ownership interest in AAA.
