And just a couple days earlier, also hispanic and wearing a white hoodie. Would this be considered a Vehicle Invasion, since there were people in the car?

Last night's shooting of two men during what appeared to be a botched home invasion robbery remains under investigation. The two alleged robbery suspects were shot by one of the occupants of the residence in the 1200 blk of E. Kennedy Dr. One, a 28-year-old Loudoun Co. man, was found in the residence when Sheriff's Deputies arrived. He was transported to Inova Loudoun Hospital at Lansdowne, where he was pronounced dead. The second subject fled the scene and was apparently driven to the same hospital, but was transferred to Inova Fairfax with a life-threatening gunshot wound.

The following is updated information regarding this incident:

The second wounded suspect is now listed in stable condition at Inova Fairfax Hospital. The identities of the two men who were shot will not be released until the next of kin have been located and notified. That process is on-going at this time.

There were 7 people inside the residence when the alleged home invasion occurred. All 7 have been identified and interviews have been conducted. The only injury to the occupants of the house was a bloody nose. That person was treated and released. No one else was injured.

The Sheriff's Office is still seeking the identity of the person who drove the second suspect to the hospital. Anyone with information is asked to call the Sheriff Office at 703-777-0445.

The Sheriff's Office will not publicly speculate on a motive at this time, but the incident is not believed to be gang-related.

Unless some breaking news occurs, the next update on this case will likely be released after 5PM.

I was wondering how a CC or OC citizen should handle this situation. I don't want to assume which is why I am asking here.

So if one was witnessing this incident ...

Should you draw your firearm, instruct the suspect to drop the weapon, and then instruct the suspect to spread eagle on the floor? Then have someone call 911 and wait for Law Enforcement to arrive? But then when LE arrives they will probably disarm and detain me, etc. That part will probably suck.

Also, if the suspect makes a run for it, then as a citizen we can't pursue, correct?

I hope to never be in this situation, but would like to be educated on proper procedures.

Any input would be appreciated.

Thanks!

First.. I am not a lawyer.. and this is NOT legal advice.. I can't tell YOU what to do.. I can only tell you what I would do. I would be a good witness for the cops. Maybe take out my digital camera, take some pics/video of the guy and what car he got into. I may have yelled out "HEY!! LEAVE HIM ALONE!.. THE POLICE ARE OUT FRONT" something to throw him off. Two many variables. From what I read.. I would not have drawn.

Also sounds like you should attend one of user's legal defense seminar. Check the sticky at the top of the forum on 6/11
