No, I don't see a way they could.

They can take assets involved in crimes. Going to an illegal party is a crime, and your car can get impounded if you do it, and it's fair to be charged to get it back. It costs money to tow and store a car. Drug dealer money isn't really useful when they're in prison, and I'm all for the police using it. Beats them spending my money.

But a legally carried gun, no. I don't think anyone here has ever had to pay to get a gun back after police abusively take them. You could say theszerdi did since he had to go through a court battle, but there was no official gun return charge.

I don't think it's realistically a problem. Among other things, preemption would seem to have a lot to say about that.If it ever comes up, it will be an extremely strong case for a law suit.

makes me sick! people need to do something about these leo's acting only as revenue raisers. it just goes to show howpolice have gone away from protectors and servants of the people to a group of thugs that believes they're above the law and better than average citzens.

By the looks of it is is indeed possible. According to the author's assertion of Worthy's written statement "the law allows her office to seize property without filing charges. " our fourth amendment rights are in the toilet.

Want to get really pissed, did you see the articel about forced health care?

Sure they can. If they have RAC, PC, or a warrant and decide later at their own discretion to skip filing charges. There is nothing illegal or uncommon about that.

Simple theft is another thing, but I don't believe this article is actually addressing that.

The article stated peoples charges were dropped, but they had to pay to receive the property back. You can't be charged with OC.

Regardeless I find comfort in the fact that the Constitution, gives me the authority to remove or abolish any form of govt. that violates my right to quality of life and security.

It sure does, but are there engouh MEN (yes, ladies can be MEN in this regard too if they will stand up) left in this country to actually do this.

Wow, another eye-opener! And yes, I do believe that open carriers are vunerable on this point. I've heard of several cases (not in Michigan) where improperly siezed firearms haven't been returned (even the ACLU is litigating one or two of these).

Yet another reason to shut up during a police encounter and carry multiple recorders.

I was replying to a post from Sayers, go back and look at who he mentioned, I hate pointing out the details...
