Carry in Post Offices? From an anonymous SC informant.

Got this via the Palmetto Gun Club. Item #1 is news to me, and we may want
to verify with SLED before anybody gets in trouble. I'm not sure what
questions are going to the AG, as noted in #6.

At last night's CWP Instructor's meeting, 10/21/09, SLED told us that: 1.
Concealed carry in a post office is okay. You just can't go behind the
counter.
2. SLED cannot pull your fingerprints off of the computer database, so you
have to submit two paper fingerprint cards. We have lots of these cards.
So, if you need, just ask us.
3. There are 99,000 active CWPs in South Carolina.
4. South Carolina has reciprocity with: Alaska, Arizona, Arkansas,
Florida, Kansas, Kentucky, Louisiana, Michigan, Missouri, North Carolina,
Ohio, Texas, Tennessee, Virginia, West Virginia, and Wyoming.
5. If you have a CWP you may not carry in a school. However, you may leave
the gun in an attended or locked motor vehicle if it is secured in a
closed glove compartment, closed console, closed trunk, or in a closed
container
secured by an integral fastener and transported in the luggage compartment
of the vehicle. Section 2. Section 16-23-420(A) of the 1976 Code as last
amended by Act 294 of 2004 as further amended. This act takes effect upon
approval by the Governor. Ratified the 27th day of May 2009. Approved the
2nd day of June 2009.
6. If you have legal questions, feel free to ask us. If we cannot answer
your questions, we will forward them to SLED and they have been very good
about answering our questions. If SLED can't answer the question, they
will ask a State Senator or State Representative to ask the State Attorney
General for an opinion. The AG will only give opinions to elected
officials. Several of your questions are going through that process right
now. And we will forward the opinions to you as soon as they are
published.
7. The CWP are taking 90 days. The renewals are taking 30 days. The staff
has been cut and the number of applications has doubled from the same time
last year.

I thought everybody knew this? Concealed carry is OK at the post office and in the post office parking lot..... so long as it remains concealed and you don't get caught.

............ any other words folks it is ILLEGAL ! No guns INSIDE or OUTSIDE on POSTAL PROPERTY in your VEHICLE or on your body - concealed or open !

Do not be a test case !

DO WRITE / CALL / EMAIL - ALL 535 Congress People as I have done twice in the last 6 months ! So we can do this at the Post Office, Soc Sec, BLM, USDA, and USFS offices just like we can in NATL Parks starting in FEB 2010 - open or concealed - long or short ! it is our property and paid for by our taxes !

See Code of Federal Regulations Title 36, Chapter 1, Section 232.1

(l) Weapons and explosives . Notwithstanding the provisions of any other law, rule or regulation, no person while on postal property may carry firearms, other dangerous or deadly weapons, or explosives, either openly or concealed, or store the same on postal property, except for official purposes.

...

(p) Penalties and other law. (1) Alleged violations of these rules and regulations are heard, and the penalties prescribed herein are imposed, either in a Federal district court or by a Federal magistrate in accordance with applicable court rules. Questions regarding such rules should be directed to the regional counsel for the region involved.

(2) Whoever shall be found guilty of violating the rules and regulations in this section while on property under the charge and control of the Postal Service is subject to fine of not more than $50 or imprisonment of not more than 30 days, or both. Nothing contained in these rules and regulations shall be construed to abrogate any other Federal laws or regulations of any State and local laws and regulations applicable to any area in which the property is situated.

Little late to the discussion, but going to summarize as a USPS Union officer/steward and CWP holder.



1) Anyone employeed by the USPS cannot carry a weapon on postal property in a car, on your person, and etc ON or OFF the clock. Your car as an employee, while on postal property is subject to search voluntarily by the Inspection servericesand refusal to do so will get you a nicely written letter banning you from parking on postal property forever. No joke, it's happened. These regs can be found in the ELM and other postal reg books.

2) Private citizens, not employeed by the USPS ,may have a handgun in their cars in the parking lot as allowed by the state laws. Decolignyposted the Federal reg on this already.

These are the key words of that Fed reg. The storage of weapons on postal property is within the facility itself, as some person think that PO Boxes are storage (yes, not just mail but storage).

And carry only occurs when you have it on your person.

Again, that's not what I wrote in any way. Do you just want to ignore the wording of NO CARRY? The vehicle is an extention of your personal property/home basically (this is the only way I can explain this), keep the firearm in your car while you run inside to get a stamp or package mailed.

As for "offical purposes", if that's what you believe it means, best of luck to you with that one. And I pray that your just goof'n

The "except for official purposes" is in regards to the purpose of carrying the firearm, not the purpose of your being in the Post Office.

If you are a Postal Inspector, and you carry a firearm as an official part of doing your job, then you may carry a firearm in the Post Office.

If you are a Police Officer, and you carry your firearm for the official purpose of being a cop, then you may carry a firearm in the Post Office.

If you are mailing a rifle, then the official purpose of carrying the firearm is to mail the firearm, then you may carry the firearm in the Post Office.

The "except for official purposes" is in regards to the purpose of carrying the firearm, not the purpose of your being in the Post Office.

If you are a Postal Inspector, and you carry a firearm as an official part of doing your job, then you may carry a firearm in the Post Office.

If you are a Police Officer, and you carry your firearm for the official purpose of being a cop, then you may carry a firearm in the Post Office.

Folks it a violation of Federal law to carry on postal property period. The above federal regulation is quite clear. The uneducated / misinformed opinion of a postal employee or hearsay from your gun club buddy will not be a successful defense when you get arrested. Look up the law ! Many post offices have postal police working out of them and this could be a problem. Lock your weapon in a brief case or other lockable compartment within your vehicle when in this type of situation. Search of locked compartments with a car always require a warrant.

This keeps getting posting on this site in several state sections and it's setting some poor guy up for a real problem.

Please stop posting this crap, someone is going to end up in Federal Custody because of this stupidity.
