    Hi, I saw this video and I wanted to ask folks that are probably more familiar with the subject or completely unaware of these facts.

    I verified the info in this video on the BATF website a few weeks back, and I've also seen it quoted a couple of times in various places.

    Can anyone elaborate on this or post comments on what they think about it?

    The facts won't get in the way of an overzealous federal prosecutor. I won't be the test case, but good luck to whoever gets the chance. That's another one that would most likely go to the SCOTUS. Er, what was the location of the definition of 'firearm'? Are there not other definitions somewhere in federal law?

    OK I found this. I highlighted in RED the pertinent language below in 3 posts (stupid computer!)

    In brief:

    In the Federal Code, the IRS defines firearm. Why this is applicable to Homeland Security I have no idea.

    The Federal Code also defines handgun in the "Crimes" section. The definition is quite a bit more in line with what we are familiar with.

    I guess, lacking any other conflicting info, if a Federal Law calls something a FIREARM versus a HANDGUN, the lawyers could have a field day. I wonder what percentage of our Federal laws use firearm versus handgun versus something else.

    I still wouldn't want to be in the middle of this mess.

    IRS Code Definitions:

    (a) Firearm
    The term “firearm” means
    (1) a shotgun having a barrel or barrels of less than 18 inches in length;
    (2) a weapon made from a shotgun if such weapon as modified has an overall length of less than 26 inches or a barrel or barrels of less than 18 inches in length;
    (3) a rifle having a barrel or barrels of less than 16 inches in length;
    (4) a weapon made from a rifle if such weapon as modified has an overall length of less than 26 inches or a barrel or barrels of less than 16 inches in length;
    (5) any other weapon, as defined in subsection (e);
    (6) a machinegun;
    (7) any silencer (as defined in section 921 of title 18, United States Code); and
    (8) a destructive device.
    The term “firearm” shall not include an antique firearm or any device (other than a machinegun or destructive device) which, although designed as a weapon, the Secretary finds by reason of the date of its manufacture, value, design, and other characteristics is primarily a collector’s item and is not likely to be used as a weapon.

    Did I read something wrong here? I thought I saw that a silencer in and of itself is a firearm. Are my eyes going goofy, or did I just read that?

    What the hell?! That makes a piece of pipe a firearm, if you think of it. But what do I know.
