Yeah, I really mistakenly created this, but I'll use it.

So I'm in the Concord area and will be looking to do a little OCing. Are there any particular places that we already know are OC unfriendly? Other than government property, schools, etc?

Generally speaking malls don't post on the doors. They write it into their code of conduct and post it somewhere in the mall. Makes perfect sense to me. :banghead: If it's a mall you can figure it's posted. I don't know of one that is not. I try to stay out of them myself.

The law says conspicuously posted. "mall rules" located somewhere inside does not meet this qualification.

How am I supposed to know before I enter? By that point I would already be breaking the rules.

It isn't on the doors, so I carry there.

Yeah, I thought in NC that a property had to be posted with a sign at all entrances. At Concord Mills, there are no signs that display this.

muccione: Yeah, thats me. I'm all over the interwebz. :celebrate

Yeah, I did not say it made sense. That's the way I see it too. I know which way to get in if I ever need anything. IIRC, Concord Mills posts the entrance from Bass Pro to the mall. It's been a while since I have been there and I did not CC at the time. So I could be wrong. Some stores do not post their entrances from the outside. You can OC or CC in Bass Pro, I would bet that would get you escorted out of the mall proper though.

Someone correct me wrong if I intrepret this wrong, but a sign has to be posted at every entrance that one could go in through in order to prevent CCW on that property.

(c) A permit does not authorize a person to carry a concealed handgun in the areas prohibited by G.S. 14‑269.2, 14‑269.3, 14‑269.4, and 14‑277.2, in an area prohibited by rule adopted under G.S. 120‑32.1, in any area prohibited by 18 U.S.C. § 922 or any other federal law, in a law enforcement or correctional facility, in a building housing only State or federal offices, in an office of the State or federal government that is not located in a building exclusively occupied by the State or federal government, a financial institution, or on any other premises, except state‑owned rest areas or state‑owned rest stops along the highways, where notice that carrying a concealed handgun is prohibited by the posting of a conspicuous notice or statement by the person in legal possession or control of the premises. It shall be unlawful for a person, with or without a permit, to carry a concealed handgun while consuming alcohol or at any time while the person has remaining in his body any alcohol or in his blood a controlled substance previously consumed, but a person does not violate this condition if a controlled substance in his blood was lawfully obtained and taken in therapeutically appropriate amounts.

In one sense you are right - the "common" teaching of the rule is that notice must be posted on each entrance, the problem is that there really is not solid case law for such interpretation. that means anyone relying on that defination, depending ont he DA and police, could very well become the test-case.

Also, there is some argument over what constitutes proper signage for notice, i.e. is a "no weapons" sign enough, or must it say "no concealed weapons"?

And of course, the bitter irony is that no weapons signs, or even no concealed weapons signs have no legal weight against anyone except a concealed handgun permit holder.

So what I posted is not considered correct? How would one know that a store is not CCW friendly without a posting on a door or with a pre determined knowledge that the area is weapons free zone.

I guess it is more gray area...

I am just saying that the statute itself does not layout the requirement that notice be posted at each entrance.

And since the statutes does not spell that out, some anti- DA could try to make a charge stick despite no sign at the door....

The mall in Greensboro has it in their code of conduct, but I have carried there before. I rarely go to the mall. I have been told that OC at the mall will get you kicked out very quickly (at least in my mall). I only carried once or twice there, and they may not have noticed those times.

I agree completely, if it is not conspicuously posted on EVERY door, then I carry:celebrate

Look at this:

http://www.ncga.state.nc.us/EnactedLegislation/Statutes/HTML/ByArticle/Chapter_14/Article_35.html

This is the law on where you may and may not have a weapon, and the first section covers where you may and may not conceal carry.

If you are CCH, and they aren't listed here then you carry in the place unless they have a sign. If they have a sign, you should politely let them know that you will not shop there.

My 2 cents....
