OC and oops! accidentally concealed - ?

Here's another scenario. You are with a group, sitting down at an open air cafe while OC and somehow by accident your weapon is concealed. Could happen in a couple of ways, such as your tucked in t-shirt comes out and covers your gun. Or a sudden gust of wind blows the table cloth on your piece. Or someone accidentally drops a napkin on yourOC.There may beother ways. All this without you being aware of what has just happened. Unlikely, but possible.

Now someone sees you withpart ofa gun being worn, more or less concealed. Same person waves a passing cruiser and points out the UOC who is not aware of the change from UOC to UCC. Officer comes up to you and proceeds to ask you to kindly stand up and put your hands above your head interlocking your fingers, etc, etc.

What now? *Could* you be charged with UCC?

I know, I know,far fetched, something that could be classified as highly unlikely to happen, but nevertheless, could happen.

What say ye?

I do believe but not sure that in order for it to be concealed it has to be intentional. Personally every couple of mins I run my hands palm towards my sides between me and my weapon/magazines to make sure my shirt is clear.

I will read the law and edit if I can cite.


*edit* I could not find anything in the PC to cite. I would just suggest using your SA to monitor the situation of your firearm. Whenever I am Carrying I am constantly monitoring my weapon by either the above action or simply feeling it with my elbow.

California law makes no exceptions for "accidentally" having your unloaded firearm concealed, even for a moment. It's a shame.

Well, at least printing or incidental exposure while carrying concealed under a license to carry isnt a crime, as it is in Texas. Of course, local issuing agencies have demonstrated their thuggery in the past about exposure.
