9.48.010 Possessing firearms prohibited.

A.It is unlawful to possess a firearm on the grounds of or within the following buildings owned or leased by the city of Fort Scott, Kansas:

1.1 E. 3rd Street known as City Hall;

2.1869 Indian Road known as the Fort Scott Municipal Airport terminal building;

3.723 Scott known as the Fort Scott Swimming Pool;

4.400 N. Hill known as the Animal Shelter;

5.1604 S. National known as the Public Safety Center;

6.201 S. National known as the Public Library;

7.602 Ivy known as the Asphalt Plant;

8.1 E. 3rd Street known as Memorial Auditorium;

9.735 Scott knows as Buck Run Community Center;

10.601 N. Barbee known as the Wastewater Treatment Facility;

11.910 Burke known as the Water Treatment Plant;

12.2104 Sidney known as the Public Works Maintenance Building;

13.Any other city owned or leased building if said building is conspicuously marked with signs stating that firearms are prohibited in such building.

B.This section shall not apply to:

1.Duly authorized law enforcement officers, fire personnel authorized to carry a firearm pursuant to K.S.A. 31-157 and amendments thereto, or military personnel when engaged in their duties to the extent permitted by federal or state law.

2.Public officers or public employees trained and duly licenses in firearm safety while on the grounds of or within the Fort Scott Municipal Airport terminal building for the purpose of performing periodic deer harvests.

3.Attorneys when the firearm is possessed solely for the purpose of attempting to submit the firearm into evidence or examining the firearm in the course of a pending court proceeding.

C.For the purposes of this section, a firearm is any weapon designed or having the capacity to propel a projectile by force of an explosion or combustions that is calculated to or reasonably likely to produce death or serious bodily injury.

D.Any person who enters the grounds of or a building listed herein with a firearm in violation of this section shall be required to forfeit the firearm, either temporarily or permanently, and may be required to leave the premises regardless of the public nature of the grounds or building.

E.Violation of this section shall be punished under Chapter 1.16.010 of the Fort Scott Municipal Code.

12.28.190 Discharge of firearm prohibited--Penalty.

No person shall hunt or discharge firearms of any kind on the lake or on the land described in Section 12.28.020. Any person who violates any of the provisions of this section shall be guilty of a misdemeanor, and shall be subject to a fine of not to exceed two hundred fifty dollars for each such violation.
