The Firearms Freedom Act http://apps.leg.wa.gov/billinfo/summary.aspx?bill=2709&year=2009is the bill that would nullify any Federal regulation or intrusion into firearms, accessories, or ammunition made and retained in the state. Whatever its chances, this is a great bill that should get some support, so if nothing else they'll be more likely to bring it back after the next Republican sweep.

Dear House Judiciary Members,

I am writing to ask that you grant a hearing to HB 2709, the Firearms Freedom Act. Enactment of this law will, among other things, greatly help to curb abuses of the National Firearms Act by Federal authorities in this state.

You may be aware of the local case of Albert Kwan. The FBI wanted to lean on him for information in connection to a murder case. Failing that, they arranged to get a look at his gun collection so they could fabricate violations. They accused him of owning an illegal semi-auto M14, on the basis that it hypothetically "could" have the welded full-auto parts cut from it and replaced. This gun had originally been converted to semi-auto and sold to the civilian sector BY THE US GOVERNMENT. They also accused him of owning a "short barreled rifle" after finding a shoulder stock that actually belonged with a legally-configured weapon, but hypothetically "could" fit on another pistol, creating a relatively useless weapon that was technically illegal under a law that was originally created to prevent gangsters from concealing vest-penetrating rifle-caliber weapons under their coats. Both convictions were finally thrown out, but not before his life was ruined.

Another example is the Arizona case of Rob Stewart, who made some machine guns completely from scratch within his state. He was convicted on the basis that the machine guns hypothetically "could" enter interstate commerce and thus affected it.

The National Firearms Act and its Commerce Clause justifications have nothing to do with either revenue or preserving order, they're instruments of terror to be used against legal gun owners. The NICS system and the requirement for Federal permission to exercise a right are likewise a Federal invasion into policy business that belongs solely with the state.

Taking steps toward reasserting freedoms lost to the Federal Government will go a long way toward restoring faith in our state government, and this bill helps accomplish that. Please grant this bill a hearing.

I'm a big fan, but what serious chances does this have of passing? Let's look at it compared to the other bill.

This one brings our laws closer to the spirit of the 2nd amendment, while the other one would basically revoke at least the 4th. Winner: this one.

This one would increase visibility of guns - something that makes your average person scared. The other one appeals emotionally to scared people by ensuring the bad guns go away. Winner: the weapons ban.

This one has no appeal for the media, except as "increasing the number of guns". The other one is touted as being proposed because of the recent violence against police officers. Winner: the weapons ban.

In short, this bill is common sense, has no public appeal, and no publicity factor. How many laws like that have you seen make it through the legislature lately?

Methinks you put way too muchimportance onwhat the media says. It's already been enacted in two states, and SAF is working it through the courts now. It's been introduced in 19 others, ours included, and will be introduced in up to 10 more this year. This idea is taking off.

It's hard to believe sometimes, but the average person can actuallydo a pretty good job of telling a good idea from a bad one when it's properly explained to them. Doing that explaining, as well as showing lawmakerssupport for good ideas, is what we need to get busy on if we want thoselawmakers to keep bringing back ideas like this, rather than sweeping our issue under the mat like they've more typically done in the past. We have a chance right nowto get our issue moving on many fronts and keep it moving, if we don't let it wither.
