Don't forget, police can arrest you for ANYTHING..
I'd press a complaint for false arrest then..... Maybe sue. They cannot be allowed to get away with that type of behavior.

Any person permitted to carry a concealed handgun, who is under the influence of alcohol or illegal drugs while carrying such handgun in a public place, shall be guilty of a Class 1 misdemeanor. My take on this is that you have to be convicted of one of the statutes listed in order to be deemed "under the influence" while carrying a "Concealed Handgun".

So, If he had just taken a drink of his just ordered beer and was "open carrying", what crime did he commit????????

Scary carry does not help normalize gun ownership - and drinking while open carrying in the vast majority o people's opinion is about as scary or scarier that open carrying with the gun in your hand and not a holster - both activities being legal in Virginia.

Fortunately almost every gun owner in Virginia knows better than to drink in public while open carrying and to stay away from the bar area of a restaurant even if you are not drnking - one good deterrant to this is that in Virginia, like most states, you can be arrestedand convicted for public intoxication without any evidence of blood alcohol content - simply the officers' testimoney that you appeared intoxicated can suffice - and by the way, a conviction for public intoxication in Virginia is grounds to revoke your concealed carry permit.

I really need to start working on that open carry class for law enforcement. Its been something I've been meaning to write for some time. Just need to show the LE agencies that they'll benefit from it.
Use Norfolk PD and Danbus as the examples of Why they would benefit from the class!

+1 I was just talking to a Loudoun Deputy about the very same thing. He was asking me if I would do a class for his "team". I am still thinkin about how I would want to present it.
