Open Carry in State Parks

Now that Bob McDonnell is the Governor, we need to contact him to issue an executive order to change the regulations in state parks to allow open carry per his Opinion as the Attorney General of Virginia. As you may recall, it was an executive order from former Governor Tim Kaine that prohibited them from changing the regulation after the AG's opinion.

This request should also be expanded to State Forests (or perhaps a separate request.) If the National Forest carry restriction is via a state agency and not via legislative code then that could be addressed too.

Can he issue an EO declaring public university gun bans illegal? Since they are state agencies...

GMU etc. "Shall be at all times under the control of the General Assembly". They are not under the control of the Executive branch. The Department of Conservation and Recreation is an executive agency and under the control of the Governor.

What actually happened was in Sept of 2008 then Senator Ken Cuccinelli requested a formal opinion from then AG Bob McDonnell on whether it is legal to open carry in State Parks.

AG Bob McDonnell responded by saying that the Department of Conservation and Recreation (DCR) only has such authority to restrict the open carry of firearms which is expressively prohibited by law.

In March 2009 then Governor Tim Kaine sent a letter to DCR, in response to McDonnell's opinion, directing them to continue enforcement of 4 VAC 5-30-200. His letter is pretty well summed up in this sentence. "The conflicting interpretations of DCR's authority in recent years by the OAG demonstrate the ban on open carrying of firearms is not clearly wrong and is entitled to deference."
