I recently purchased a S&W 40 and love it! I have been around shooting for the past ten years due to military and buddies in gun clubs. i have read the Local Denver Statue and it clearly states that OC while being loaded or not is fully legal. The state statue also says this. I feel completely comfortable carrying in my car and home its always loaded and on my hip. I still have not gone into a place of business while OC. Any advice?????

Yeah! Don't OC in Denver!

As for carrying unloaded, don't know, but I'd read through ever law they have on the books before I tried it, and even then, since OC is prohibited, UOC, even if it's legal, would attract a lot of unwarranted attention.

Sec. 38-117

"It shall be unlawful for any person, except a law enforcement officer in the performance of duty, to carry, use or wear any dangerous or deadly weapon, including, but not by way of limitation, any pistol, revolver, rifle, shotgun, machine gun, air gun, gas operated gun, spring gun, sling shot, blackjack, nunchaku, brass knuckles or artificial knuckles of any substance whatsoever, or switchblade knife, gravity knife, or any knife having a blade greater than three and one-half (3½) inches in length, or any explosive device, incendiary device or bomb, or any other dangerous or deadly weapon."


It does not matter if the gun is loaded or unloaded. If you OC in Denver you will be arrested.

Of course, you can OC in your car but do not get out of the vehicle while OCing.
