So, Idrove to the Seattle property unit to pick up my property. I was given my CPL, holster and magazine (also had the remaining rounds). I had to fill out a paper so that they could do a background check before they give me my handgun back. The man at the counter said that they will hear back by tommorrow, and I can come and pick up my handgun tommorrow.

That's horse hockey. If they're handing you a CPL there should be no additional background check needed. If they think you might be a prohibited person, they shouldn't have given you the ammunition - - possession of ammunition by a prohibited person is a Federal offense,18 USC 922 (g), and so is delivery of ammunition to a prohibited person. 18 USC 922 (d). At this point they are clearly messing with you (yes, I know, I have a keen perception of the obvious). For future reference, I would have tried a Motion For Return Of Property under Superior Court Criminal Rule 2.3 (e):

A person aggrieved by an unlawful search and seizure may move the court for the return of the property on the ground that the propery was illegally seized and that the person is lawfully entitled to possession thereof. If the motion is granted the property shall be returned. If a motion for return of property is made or comes on for hearing after an indictment or information is filed in the court in which the motion is pending, it shall be treated as a motion to suppress. Not 100% certain it would have worked in your situation but it might have been worth the try.

Hmmm. I can walk into a gun store with my CPL and walk out with a brand new handgun in <30 minutes. They are STILL messing with you! UNBELIEVABLE. :banghead:

No...it was not the 4473 form which struck me as odd. I figured if they were required to do a background check or going to do a background check through the Feds than I would have had to fill out the form. The form that I filled out just wanted my name, address, phone number, and drivers license number...and signature.

The man behind the counter said soemthing to the effect of, "it is required by the Brady Law" that we do this background check before we hand over your firearm. My CPL is 'active.'

Even though I have my CPL, when I go to purchase a handgun, I always have to wait three days, it has always been the case with me. It is either the result of my name change many years ago or....I seriously can't think of any other reason.

I had a stolen pistol returned to me by Snohomish county and had to do a NICS check as well.
After the check someone gave me a paper sack in which to carry the pistol. I told them that I didn't have my CPL on my person and thus the sack carry made it illegal. (I don't carry my CPL when I go to the courthouse & check a weapon) He gave me the :shock: look. I asked again how am I suppose to carry the weapon to my truck. Again :shock:. They finally had a Deputy escort me to get my checked weapon and then escort me to my truck.

oh come on m1! 9.41.060 (9), im thinkin a paper bag is a closed opaque case or a " secure wrapper ",, and i recall meeting you, you are " any person".:celebrate

OK, this is actually getting rediculous. So I filled out the "background" check yesterday, and the man behind the counter told me that I can come the next day, which is today, and pick up my handgun.

Apparently, they are now saying that I can't pick it up for 3-5 days. I told her that I have an active CPL, and she said that it doesn't matter.

Am I just being a complainer, and impatient?...I like to think I'm not.

Unfortunately Sylvia our CPL is not a replacement for a background check as you know and that unknown to us the delivery of a firearm can take up to 3 to 5 days depending on the NICS check.

I have attached a copy of the form that I signed for the background check. What is highlighted in the RED are the places that they call, as well as doing the FED background check.

I received a call from my councelor at a counceling service I go to...they called her stating, "we are calling to inform you that your client.......has a handgun." The person who called didn't ask any questions about me, and kept it professional. I just thoguht it was odd that they would call my councelor to tell her that I own registered firearms.

I would love it if someone can site either Constitutionally my right to me having the privacy to own firearms. Or a State law that says that it is not a violation of individual's privacy for the State to actively call, and inform individuals that you own firearms, or that you are receiving your firearm back from the police.
