Best Buy General Manager gets a lesson on store policy

I had a less than pleasant experience at a store I have been shopping at for years. As a matter of fact, my very first paycheck went to best buy in it's entirety if memory serves.

I walked into the Gastonia, NC location around 11:45 local time. The Greeter named Courtland welcomed me and I replied with a "Thank you." Once I got a few steps past I heard Courtland ask me that question open carriers receive oh so often. "Are you a Law Enforcement Officer?" I turned around, walked back towards him smiling explaining no I wasn't. I find the least I can do to put people's nerves at ease is to smile. :)

Courtland then began to explain how he was pretty sure I could not bring a firearm into the store because it scares people. I asked him if this was the company's policy to which he replied "Yes, I think it is."
"Well is there a manager I could speak to just to confirm?"
Thus began the waiting. The greeter began to call "Supervisors." Whilst waiting I looked around at the other customers, one being an elderly man standing right next to me. To no surprise, absolutley no one seemed scared. I carry myself in a proffessional manner, my clothes were clean and not at all the typical dress our local malefactors seem to wear. No doubt these factors more than likely attribute to why I have never experienced "scaring" another person because I wear a firearm on my hip. After 2 calls Courtland offered to allow me to shop while he tried to get a hold of someone. I declined the offer and expressed I'd be more comfortable knowing the store's policy before shopping.

Finally after about 5 mins (which is a lifetime considering all I wanted to do was glance at the prices of SLR cameras) I was met by Joe Marshall. Joe told me he "could not allow me to walk around with [a] firearm." I asked Joe if this was the corporate policy and he told me it was. I then asked Mr. Marshall if he was aware that "there is no posting on any of the doors.." I was interrupted at this point and was told,
"I can call the Police if you want. I'm not going to argue legal.." Quickly taking a page from Mr. Marshall's professionalism I interrupted him at this point.
"That's fine, I'm not arguing. I simply want to know if you yourself are aware that there is no posting." To which he replied he did and would "send that up." Not entirely sure what that meant but I decided to leave it at that. I asked for his name and title, shook his hand, thanked him for meeting with me and left.

One 12 minute call to Denise at customer relations was all it took. She confirmed for me that the policy is what I thought it was. They simply follow the law of the state. I told her my experience and she called Joe Marshall and quickly educated him of Best Buy's policy while I was on hold. She then told me if I were to shop at Best Buy again I would be allowed to open carry. Which is a bit strange to hear because I have open carried at that store 3 times this year alone, but I am glad we are all on the same page now.

Well I will try again to get a look at those cameras but will probably have to buy something just to make the trip worth the extra gas back and forth. Perhaps a Blu-Ray. I really like Best Buy and am glad I can continue shopping there.

Have you ever noticed that when you go into little local "mom and pop" stores, you NEVER get hassled. And these big corporate giant stores seem to always have some out-of-state manager who wants to make OC an issue. That's what happens when these mega corps shuffle their managers around from state to state--you get someone from MD or NY or IL shuffled to a state like VA or NC, and they just think that the fascist gun laws they grew up with are universal, and they hassle you.

I've shopped in Best Buy stores in Raleigh, Fayetteville, Greenville NC, and in several locations in VA, PA, and WV, and I've never once had an issue. I had some salesmen in a BB in Raleigh ask me a LOT of questions one day--about my firearm, about the law, about CC vs OC--but they were positive, interested, and curious, not hostile to the idea...

I'm glad you got that manager straightened out. Hopefully he will be more polite to other OC customers in the future.

I have only been asked to leave one store--a big consignment store in Greenville--and I complied politely as soon as the manager asked me to leave. However, I did hand him a card with NC OC info on it, and I made it a point to politely tell him that I would be filing a full report of his policy on a NATION-WIDE gun rights internet forum. It might not change their mind, but it lets them know that you will spread the word about their policies to THOUSANDS of other lawful gun owners...

Courtland was on break once I re-entered. I wanted to touch base with him and let him know I am in fact allowed to OC there so he wouldn't try and stop me. I glanced at SLR cameras, then went to the Blu-rays. Couldn't convince myself to buy one. Netflix has put an end to my movie collection. I started walking out and saw Courtland. I decided it wasn't my problem to worry about the training of Best Buy employees. So as I walked out I said "See ya!" The look on his face told me he had not yet been informed of the call I made and he more than likely would have tried to stop me coming in. ^_^ The GM was no where to be seen.

First, glad it worked out. Second, find a way to prove your point without mentioning signs. They're worthless for OC anyway, as they only legally apply to CC. They could hit you with trespassing but not a carrying charge. There is a letter from Best Buy about OC on the main page somewhere.

I am glad that the re-education was successful. However I would hope that future encounters do not end up with "I will call the police." Good job on keeping you cool. And bad on the manager for escalating the conversation. Either way you are a customer and you should be treated as such.

Bass Pro. Inc. Clarifies Policy – Open Carry Welcome!

OpenCarry.org (OCDO) is pleased to announce that Bass Pro Inc. advised OCDO co-founder Mike Stollenwerk by telephone today that open carry of holstered handguns is as welcome as concealed carry provided all federal and state laws are followed.

After being contacted by OpenCarry.org (and apparently some of our almost 20,000 some thousand members) about sporadic inconsistent treatment of open carriers at some Bass Pro shops, Bass Pro’s Manager of Communications Larry L. Whiteley asked OCDO co-founder Mike Stollenwerk for more background information and some time to straighten things out.

Stollenwerk advised Whitely two weeks ago that open carry is legal in most states, usually without a permit, and that Sportsmens’ Warehouse and Cabelas have adopted clear corporate policies welcoming open carriers in their stores just as they do concealed carriers. Further Stollenwerk noted, it’s better to adopt one clear corporate policy than allow individual employees make up store rules or give legal advice to customers, i.e., the proverbial but well meaning, “psst, hey, you gotta cover that up, it’s the law” kind of thing, which can get gun owners in trouble for breaking the law and unlawfully concealing (e.g., in Wisconsin where no permit to conceal is even issued).

Well today Mr. Whiteley called and confirmed that Bass Pro’s policy is and “always was” to be to respect lawful customer gun carry, concealed or open, and that steps the following steps are being taken to ensure this policy is understood by all managers and employees, including production and distribution of training videos as well re-drafting of signage pertaining to guns.

OpenCarry.org is pleased that Bass Pro. joins both Sportsmens’ Warehouse and Cabelas in clarifying to OpenCarry.org that open carry is welcome in their stores as a matter of corporate policy.

You mean the "No Weapons" sign I have seen only apply to CC? I thought the sign was a way for the owner of a private property to express whether or not they allowed firearms on their property? Could you help me find legal information on this please?

Well, yes and no...

The "No Weapons" signs or "Circle/Slash" no guns signs ONLY make it a WEAPONS VIOLATION if you are CCing and get caught.

If you are OCing and they ask you to leave and you refuse, it's a TRESPASSING violation, not a WEAPONS violation. If they don't ask you to leave and just call the cops, then it's your word against theirs, unless you've been video recording the event since before you entered the doors. If thy ask you to leave and you DO, it's "no harm-no foul". But if you go back at a later date. carrying, then you're getting into a pretty sketchy area as far as trespassing.

If a store is NOT posted, and you are OCing, and they ask you to leave, and you do, again--no harm/no foul. But if you go back at a later date, carrying, and they still don't have signs, then it's back to "square one". Unless they issue you a formal "ban from the property" or some such order, the only way they can prevent you from entering a non-posted business while carrying is to ask you to leave. And it's NOT trespassing if you go back, unless they told you that you are banned from the property.

At least that's the way I understand the law. But IANAL, so my opinion is worth EXACTLY what you paid for it... ;)

So if you want to be a "test case" on the legitimacy of signage in NC, and you are OCing, you'd better have a few friends with you, or someone with a video camera following you around.

I do know I have to leave whenever asked and would always do so, bee-lining straight to corporate to confirm policy then this forum. =) Perhaps both simultaneously. XD

On a side note, I like pizza!
