    As i feel the need to continue to seek information about the detainment for mental evaluation AND weapons seizure here in Medford by three local law enforcement agencies i have decided that a little local display of concern is warranted.

    It is my plan to contact REPEATEDLY the Medford Police Department, the Jackson County Sheriffs Department and the Oregon State Police for information about this incident. I fully expect to have my requested denied as has happened to the Mail Tribune. I will then file complaints with the Medford City Hall, the Jackson County Commissioners and the State Attorney Generals Office. I will attend ALL city council meetings OPEN CARRY as is my right as a CONCEALED CARRY PERMIT holder. I shall not resist a lawful order of LEO, (do they KNOW what the laws are?). There is no place here for violence on anyones part, as proof I plan to have friends nearby with cameras to record any contact.

    My record is clean, i have no warrants or unpaid tickets. I have up to date car registration, insurance AND drivers license. I plan on recording ANY AND ALL conversations with city , county and state officials as well as law enforcement regarding this effort. I may even purchase yet ANOTHER firearm just to prove that my record is clean as of the date of the purchase. I have been laid off for quite a while and i am not afraid to spend some time in jail to prove that some things are worth fighting for.... for me, its the "Bill of Rights". The 2nd and 4th amendment should be recognized in Southern Oregon too!

    As to the audio recording (even if part of an audio/video recording) don't forget to do the mandatory INFORM (not permission).

    Just in case you hadn't seen any threads on THAT rediculous piece of legislation they like to pop us with for simply trying to ensure that there is a fair and unbiased accounting of any encounters.

    I was mainly referring to any police or security officer who might engage you prior to or after entry. While the council proceedings being recorded has been announced, that you are recording has not. The law requires YOU to inform if you are recording.

    IF they want to mess with you they will use it even if technically it's a DUH.

    Doesn't have to be concealed, just running and you didn't "INFORM".

    The relevant law is: ORS 165.535 (Definitions) ANDORS 165.540 (1) (c) (the part they'll ding you on) AND ORS 165.543 (penalty is a Class A misdemeanor). Reading it is a bit tricky (but the cops twist it all up or you real nice when they can't ding you on a weapons charge).

    It's stupid but it has been used to trip up several members of this board. Here is the link to the thread here where that case (Portland) was discussed at length.

    wish there had been a definate end in the case that you mentioned, a plea bargain did no good. thank you for the link, forewarned is fore armed. may just get an open carry shirt and have it printed "YOU ARE BEING AUDIO TAPED" , it makes the assumption tho that the police can read AND understand english..... if we were sure that they could do that, we would not have many of these posts

    Yeah, it's a bogus law and it sucks that the Portland case went on a plea bargain because it allowed the state to get over on it. On the other hand, the guys that got hung up with it were caught flat footed by the recording statute (which I'm sure the cops didn't even know about until after the gun "crime" didn't stick and they started digging for SOMETHING).

    I've considered getting either a hat or some T shirts printed with "you are being audio recorded".

    There is apparently case law, though I don't have it handy, that says basically.....you have to inform that you are recording but the person being informed is not required to understand or comprehend that you are recording.

    Not sure how that would work out with a shirt or hat.

    I can assure that the people who are directly involved with the situation (the person who had been checked into the psych ward), plus Kevin Starrett of the Oregon Firearms Federation and other allied civil rights groups across the nation are fully engaged into the situation in Medford. MPD and OSP committed MASSIVE civil rights violations on the level I haven't seen in a long time. Though certainly is your right, I would ask that you consider contacting both the guy who had it happen to him first along with Kevin and ask them what they think about the situation. If the gun owners of Oregon need to rally together in a full on fashion and start hammering the living @#$% out of MPD and OSP, Oregon Firearms Federation will put out an alert, which I will gladly post in this thread for you to follow.

    If I was treated in this fashion by the departments involved, I'd be on the phone to a good lawyer and hit them with a 42USC1983 lawsuit. At the moment, they will treat you like a "random loon" type and ignore you. Let Mr. Pyle hit these guys with the hammer of the federal court system first.

    By all means record public conversation with cops, but don't go out of your way to engage in conversations with law enforcement just to "get them on something".

    He's not random and he isn't the only one. I OC in this down daily and I will NOT stand for this crap.

    On the other hand, I too know that Mr. Pyles is doing what needs to be done. It's sometimes difficult for the rest of us to not hear the victims side of the story but the absolute best thing for him to do is not talk to anyone about anything and get his legal case against this abomination going.

    I'd love to talk to him personally myself but he doesn't know me from Adam and for all he knows, any random contact could very well be a set up by the government.

    There is a Medford City Council meeting the first and third Thursday of each month, two sessions (noon and 7pm) in room 300 at City Hall. Both meetings are open to the public. They need to hear from us, face to face, and as citizens we have the RIGHT to address the Council from the podium for THREE MINUTES as an individual or FIVE minutes if representing a group.

    If there aren't answers soon, and much better than the "City CYA" garbage that has been handed down from the local rag, people here WILL start going to the Council meetings and demanding a full and public accounting of Mr. Pyles treatment.
