A couple of basic Nevada Questions

I'll be flying into Las Vegas and then driving to Utah.

If my firearm is unloaded and in a locked case, can I keep in in a piece of luggage (ie concealed)?

I don't feel like talking to the police. If I open carry around a casino property will I get harassed by LEO's or casino owners?

Can I keep my gun on my hip on an external holster while I'm driving my car?

When I OC, does the chamber have to be empty?

What areas do I need to avoid? (Schools, federal buildings, etc)?

Can I keep a loaded magazine in the locked gun case while it's in my car or luggage (if applicable)?

Anything else I should know? It's really too bad that Utah and Nevada no longer have reciprocity.

Inside luggage is how you're required to fly... Technically it's concealed, but I doubt you'll be dinged for it in a locked container (I doubt anyone will find out too)

LEO's, maybe. If someone calls they'll come talk to you but nothing is illegal. Casino owners have the right to boot you for any reason, including OC.

Yes, locked and loaded. Welcome to NV.

The two you listed for sure. Federal buildings are off limits per Federal Code, NV Public Buildings are 'technically' legal for OC (because CC is prohibited by statute, but OC is not addressed). I personally stay away from Government owned buildings and schools.

Yes. NV has no laws regarding loaded magazines that I'm aware of. Rifles need to have an empty chamber if they're in your car, pistols can be loaded. Detatched magazines have no regulation.

Loaded OC is legal. If you google NRS 202.3673 you can read the concealed weapon laws for yourself and gather your own opinion. Nothing I've typed will keep you out of jail, but rather is my understanding of the laws as written. IANAL.

Careful there. It has to be declared that it is the luggage before you fly. It has to be shown to be unloaded and then the airline ticket agent watches you lock and gives you and it a bright orange tag. One tag goes in the gun case. You could have a locked pistol case and then put that inside another suitcase. That is the best way so that once you have been checked out by the airline agent and your gun is off to the plane it is not just a pistol case by itself. I fly alot with pistols and rifles. It is something that I have never had a issue with as the agents are very versed on the rules.



Now I really think the OP was asking if he stowed it like that while going to the hotel and driving etc. That should also not be a issue. It for sure is not a issue in the car. Going into your hotel should not be either if it is in the suitcase and then in another locked container.

Also don't forget. If your going up I15, you will be going through AZ for about 30 miles.
But talking about "reciprocity" leaves me to believe that you have a UT ccw. So I think you might be good.

In my opinion it could be illegal if you ever carry the suitcase in your hand with a gun in it. It would not be discernible to ordinary observation.

I agree with Felid. Technically illegal, but most likely will not run into a problem unless a problem finds the OP. As suggested above, look over the NRS and draw your own conclusion as to concealment and what risk you're willing to take.

Another NV thread addressed the issue of having a gun in a piece of luggage. The general consensus on that thread was that if it is locked, unloaded, and in a secure case then you're "transporting" the firearm and not "carrying" the firearm. Thoughts?

There are no exceptions written into the law for transport. There are also no exceptions for being in a locked or secure case, nor for being unloaded.

In my opinion the only thing that would save you from a criminal charge (which would be a category C felony,) is the fact that no one knows it is there, and potentially an officer might look the other way.

If you were charged it would probably be worth arguing that transport does not equal carry, but I don't know that you'd win. To my knowledge no NV case law has ever provided any distinction between carry and transport. If you are transporting an object by carrying it concealed in a case in your hand, that violates the letter of the law.
