Carrying in Nevada - some tips

I just found the forum and wanted to share some tips. First I do agree that we have a right to open carry as stated in our state law, however there are some ways to be safer about it.

You want to hand them your DL, insurance, and CCW if you have. Let them know you have a gun on you and where it is at. Follow their instructions to the letter. I was stopped once and was told to keep my hands on top of my steering wheel. The stop went just fine. He also asked me to not move my hands till he drove away.

OC in casinos, movie theaters and banks
I do NOT recommend this, get your CCW and carry that way. Casinos will certainly escort you right out, some banks don't like it. Be respectful and feel free to state the law, but you are a guest of their property. Most people you deal with are just doing what they are told. Get their name and contact the office to find out the official policy.


OC on the Strip
Not the best idea, I again recommend getting a CCW. The Strip is full of people and many are drunk. Easier to not have it showing.

I have OC in Walmart, grocery stores and many places before with no problems. I think most people think you are LE and leave you alone.

According to a cop friend, a store just having the gun with a line through it does NOT prohibit you from CC. If they have the NRS statue, it is a FELONY to carry, OC or CC in that place.


These are my suggestions and how I have safely carried my side arm for over 4 years. I got my CCW as soon as I could. What they cannot see, they cannot stop you about.

Welcome to the forum! While CC is perfectly acceptable to many of us here, this forum is about promoting the open carry of firearms. Please respect that intent and purpose of this forum.

Also, your cop friend is completely wrong about carrying into a building citing NRS. Never trust a cop to know the law, you can find the actual law here:

First of all, it's a misdemeanor.

Second of all, it only applies to "public buildings" which are defined under the law as:

The Federal Government, the State of Nevada or any county, city, school district or other political subdivision of the State of Nevada and used for any public purpose.

If only part of the building is occupied by an entity described in this subsection, the term means only that portion of the building which is so occupied.
A store, casino, bar, church, whatever, is NOT a public building under statute, and any sign they post prohibiting firearms is meaningless.

Finally, in actual public buildings, that law only applies to concealed weapons carried by concealed weapon permit holders. A person without a CCW who carries concealed (anywhere other than his home) is guilty of a felony (NRS 202.350), but has not violated this specific statute. If carried openly, there is no law prohibiting it.

Additionally, state law preempts the authority of local governments from creating any such laws. Despite signs stating "NO FIREARMS" I carry openly into the DMV, the Southern Nevada Health District, and most recently to the Clark County building at 310 S Third St when I testified in front of the Citizen Review Board (yes I was OC on the witness stand).

Secondly, I'm not in the habit of reaching around my car when stopped by LEO. Last thing I want is Mr. LEO to see me reaching around wierd spots. I'll keep my hands at 10 and 2, wait til he tells me why I'm being stopped and then inform him of my firearm before reaching around to grab what he needs. Maybe he doesn't want your DL, just wants to say "Hi, your tail light is out."

Tim...ya kinda lost me on this one??? what are you saying about the signs which are posted in several buildings around town, that say No Weapons allowed.........as i read it, if you are oc the sign dont pertain to you unless you are cc....???????:what:

A sign posted pursuant to NRS 202.3673 applies only to concealed weapons. There is no law restricting the open carry of firearms and state preemption prevents there from ever being one.

You can open carry into any public building in Nevada, excluding court houses, schools, post offices, federal buildings, etc.

I just have a problem with this, the whole point of carrying a tool of such kind either CC or OC is about BEING safe so essentially the act of carrying such tools on your person for purpose of self defense would be in itself safer. Im sorry but LEs need to know about my handgun about as much as they need to know about the color of my boxers that day. all be it there are certain situations to which i would recommend informing the LEO when you have a gun such as when i was pulled over and my tool was in my glove box. if it were under my seat, sitting in my door map pocket I would not have informed him. I choose to inform the LEO about the gun in my glove box because i had to open it and dig in there for my insurance and registration papers.

few things with this, as most of us here actively have walked inside numerous places and all be it some establishments have asked us to leave and some have not. However I am not going to walk in there like a sheep head down saying yes massa. last time I checked businesses make money off citizens spending money in there, they didnt invite me in, they didnt call me up at my house by first name and say hey come visit the store but please respect us. Respect is earned not given and just because im walking into someones shop does not mean they will get my respect. after all they are the ones that should be kissing my ass if they want to separate me from hard earned cash.

your cop friend is ignorant at best to make such a statement, cops dont make the laws, they have never written a law and most of them wont know the laws. know why cops take so much time coming back to your car after they pull you over, they are looking up the vehicle code and waiting to hear a little voice tell them over a radio or a computer your clean or not.

This forum is dedicated to OCing hence the domain name opencary.org....we arent preteens still smelling of pee here, most of us know the laws inside and out and most of us take our personal defense very seriously. I would venture to say most of the women and men here on this forum are more educated and trained then your run of the mill rookie cop. suggestions and opinions are always welcomed just realize they are much like assholes everyones got one. again welcome to the forum and dont take my post too much to heart its not a personal attack at all.

Welcome aboard. One small point. Nowhere that I'm aware of in NV statelaw does it codify your right to open carry. The constitution of NV states you have the right tokeep and beararms, but does not mention any type of carry. Open carry is legal simply because there is no prohibition against it.

DMVPolice station? Sheriff dept.? I know the Washoe Sheriff building has no firearms signs on the front doors but I'm not sure if they are specifically no concealed firearms.


Edit: Trying to find out if any NRS statute has any weight behind these signs to prevent open carry...

In the absence of any bark behind that bite, it seems one could open the door with the "no firearms" sign on itand walk into the sheriff's department to conduct one's business. Then let the hilarity ensue when the deputies try to enforce their policy.

I did a bunch of searching and surfing and this has been discussed here in the past, with no definite conclusion. Workers at a few NV public buildings are under the impression OC is illegal.

well a drunk trying to fight someone is a little different as it can happen if you are OCing or CCing or not carrying at all. glad things worked out though drunk brawlers are always annoying to say the least.

I didn't mention that that the reason he wanted to fight we was BECAUSE I was carrying. Odd, I know. It was a unique experience and I'm not quite sure how I feel about it yet.

Research the statutes yourself. If a private business posts a sign, it isn't worth the paper it is printed upon.

First I think you should always tell a cop that you have a sidearm with you. Most ask if there are weapons in the car. I do this out of courtesy to the officer.
Remmy what do you do when the cop says are there any weapons in here? I think no matter where it is, you should tell the officer just to make it safer. If it moves and they see it, I bet your will be hauled out of the car, put in handcuffs and have some explaining to do. Also the cop may wonder why you are hiding the fact that you have a weapon.

I fully support everyones right to carry a sidearm. I have no problem if you want to open carry it on the strip, downtown, to the store or wherever. I only say that due to the amount of stupid drunk people on the Strip, it is safer to CC if you have the permit.

I may have mispoke about the felony part. From my understanding, signs with the NRS statue carrying more weight than the signs without. A business can ask you to leave for open carrying on their property.

I did not mean to rub anyone the wrong way or imply that OC is a bad thing.

I do have a CCW. But it's getting close to summertime and it's pretty hard to carry a Springer XDm 40 without printing. Especially with a white t-shirt. It's just a lot easier OC. Plus the more that OC, then more that the sheeple will be desensitized by it.

I hear you on that one! Just reading more stories on here, it is amazing how people are. You're not a cop then why are you carrying, or get out. Really dumb. People see a gun and freak out.

At least with the CCW you never have to worry if it does get covered by your shirt or peeks out.

A sign with a 'statute' only holds weight IF the statute applies to the specific. If I am a private business owner, I can post a sign with a statute, BUT it has no weight of law.

As for the question about weapons and cops, a good rule of thumb is to NEVER lie. If you lie, you can get into trouble. There is always the "say nothing" route. IANAL, and I did not stay at a Holiday Inn Express last night.


You will be better received if you speak specifics of law, as opposed to opinions worded as if they were actual truths.

That's your experience. My experience is no cop has ever asked if there were weapons in the car/motorcycle, or on or about my person.

I think you should remain silent just to make it safer. No sidearm is capable of moving on its own. You don't have any explaining to do, you can remain silent. The cop can wonder all he wants.
My point was to get a CC permit and you don't have to worry about most of these things.
Perhaps you are unclear on the purpose of this site and its members. I've been here only a little while and it seems to me they want to carry openly to acclimate others to it, not carry concealed to hide it. This is why they go to the trouble of carrying recording equipment, to document their unlawful harassment while carrying openly.
