That's OK though, that casino sucks. Way too smokey in there, burned my eyes with all the cigarette smoke.
They frisked you?

So, can anyone point to a law that a non-Indian could be prosecuted for violating if said non-Indian possessed a gun in a casino? I'm not talking about if said non-Indian refused to leave after being told to do so, I'm asking if there is a crime that he could be charged with, right from the get go.
I think it would depend on the the specific laws of the tribe, and if they pertain to non Indians, or just to Indians of the Reservation. I know you're asking for a specific law, but unfortunately, I'm not sure of any off of the top of my head.

Tribal laws do not apply to non-indians and they cannot make them apply to non-indians. If a non-indian breaks a tribal law/rule the only thing the they can do is trespass us from their land.

Any citation issued under this chapter shall be to a Washington court, except that any citation issued to Indians within the exterior boundaries of an Indian reservation may be cited to a tribal court. Any arrest made or citation issued not in compliance with this chapter is not enforceable.

(4) Any authorization granted under this chapter shall not in any way expand the jurisdiction of any tribal court or other tribal authority.

Pardon me if I seem a little dense LT, but my take on this is that they can write tickets until they run out of ink, but if they aren't in line with state law, they are automatically null and void?

soooooooooooo, if the premises are 18 and elderer, not liquor board mandated and lata dee da da, we can carry until asked to remove ourselves from the premise, and if we are cited by an indian type police officer, our friendly county/ state judge guy SHOULD toss it out...............:?

Actually no. A lot of them are now fully state commissioned due to legislation that was passed recently. You could get cited by a tribal officer for violating state law and it could be 100% valid and will stand up in court.

What he was talking about was a Tribal cop giving a ticket for a violation of a Tribal law, not a WA state law. Such as firearms possession. Some reservations have their regulations regarding firearms possession and if they tried to issue you a citation for illegal carrying, at say their convenience store, they could not enforce it upon non-Indian persons. They could only ask you to leave.
Aha...My misunderstanding. Thanks NavyLT.

You removed you question to me while I was digging out an answer, but I'll give you a link anyway...

http://www.nigc.gov/Portals/0/NIGC .../Upper Skagit Tribe/upperskagitcomp021993.pdf

All of the agreements between state and tribal governments appear to have wording very similar to that shown on page 19 of that document.

I'm not sure where that would fall in "laws" though...

Enjoy!

EDIT: Corrected(?) URL...
