I was detained for OC by the Castle Rock Police more than a year ago. The next day I started on a crusade to get my concerns addressed and to try to get them to admit that they were wrong. I met with the immediate superior of the officers who detained me (a Sergeant) , and he treated me even worse. I then filed formal complaints and my case was assigned to a Lieutenant.
Over the next few days I emailed this Lieutenant everything regarding my case, the law, court decisions, evaluations from lawyers, everything. They said they would get back to me in 30 days. More than 60 days later, and after multiple calls from my State Senator's office, they finally responded. Guess what they said? "We reviewed the matter very carefully and we believe that the officers in question acted in accordance with the law and our department policies."
News Flash - Most police departments will NEVER admit that they are wrong, nor will they ever tell you that you can legally do something that they don't like.
As much as I sympathize with you and your wanting to "know" that what you are engaging in is perfectly legal, you're probably wasting your time. They don't want you to OC, hence they won't tell you it's legal. They best thing you can do is arm yourself (pardon the pun) with the knowledge of the law and an impartial observer (audio/video recorder) when you go out OCing.
