Today, the NC General Assembly convened for its 2010 "short session," and GRNC Legislative Action Team members John Landreth and Jeffrey Graham, under the direction of Legislative Director Jeff Rau were there to defend gun rights.

CASTLE DOCTRINE

Judiciary I Committee chair DEBORAH ROSS (D-Wake, GRNC 0-star) continues to rationalize her unwillingness to grant a hearing to SB 928: "The Castle Doctrine," which would significantly reinforce the right to use deadly force in self-defense. In her latest dodge, Ross is blaming bill sponsor Sen. Doug Berger, claiming that NC District Attorneys object to the bill. Meanwhile, word at the GA is that Ross is actively soliciting opposition to the bill.

IMMEDIATE ACTION REQUIRED

Call Ross and NC House Majority Leader HUGH HOLLIMAN (D-Davidson, GRNC 0-star) and let them know you are not buying the latest dodge. Tell them that SB 928 is not controversial, having passed the Senate with only 6 votes against it, that it is overwhelmingly popular, and that it deserves a committee hearing.

STATE OF EMERGENCY BILL WILL BE INTRODUCED SHORTLY

Recall that in 2009, Rep. MARK HILTON (R-Catawba, GRNC ****) introduced HB 257, "No Seizure of Lawful Firearms in Emergency." In addition to preventing Katrina-type gun confiscation, HB 257 would have changed Article 36A of the General Statutes, under which carrying of firearms outside the home is prohibited during states of emergency. The bill died when Democrat leaders in the House denied it a hearing.

But last winter, the town of King, NC made national news when it cited Article 36A and invoked a ban on carrying and sale of guns and ammunition in response to an impending **snowstorm.** To ensure that this abridgement of civil rights does not happen again, GRNC and Rep. Hilton have drafted a new version of the bill, tailored to skirt legislative restrictions on offering bills during the "short session," which in part says:

"Nothing in [Article 36A] shall be construed to ...
(3) Authorize the taking, confiscation, or seizure of lawfully possessed firearms, ammunition, or ammunition components or authorize any restriction or prohibition on the possession, transportation, sale, purchase, storage, or use of lawfully possessed firearms, ammunition, or ammunition components."

'DOMESTIC VIOLENCE' GUN CONTROL OFF THE TABLE...FOR NOW

A proposal under consideration by the NC Child Fatality Task Force (CFTF) could have the potential to cause guns to be seized and registered from gun owners convicted of nothing, and who wouldn't even get a day in court beforehand.

The proposal would apply to so-called "50B orders" issued in response to alleged domestic violence. This proposal could cause guns to be seized EVEN IF THE DEFENDANT HAD THREATENED NO ONE and could be done on an "ex parte" (emergency) basis WITHOUT THE DEFENDANT'S KNOWLEDGE.

Fortunately, in response to objections by Rep. Dale Folwell (R-Forsyth, GRNC ****) and GRNC, the CFTF has elected to take the proposal off the table under next year's "long session" in order to allow all parties more time for input. (And GRNC will have lots of input on this one...)
