If I missed the answer to this somewhere, forgive me. I've been looking for a bit, and couldn't seem to find a definite answer.

I've recently began excersing my second amendment rights, and have signed up for a CPL class. I've had a pistol for about 18 years, one that I acquired when my father died. He had the gun registered, but I haven't touched the thing since 1993. It's been under my bed all these years. I see to open carry in Michigan, the gun needs to be registered. Does that pertain to this one? Do I need to go register it in my name? I've got my holster, I have my gun, and I've been training with it for a few months now, and I'm curious if that's enough to open carry.

First off, Welcome to OCDO :D

Second, Do not carry this gun!

The pistol must be registered to you. Since it was your dads gun, you should be able to get it registered in your name without a problem. Youll have to get a purchasers permit, someone here who knows will come by shortly and explain exactly how to fill it out Im sure. As long as your dad owned it legally, and its not stolen, you should be fine. Technically, as of now, you are breaking the law by being in posession of an unregistered pistol. They probably wont bust you though, because you diddnt know, but If I were you, I would tell them that you just brought the gun into michigan from another state.

As this gun was registered in his fathers name as per the OP, I would recommend not misleading Law enforcement as to the source of this handgun.

Just my 2 cents.

Do not make any false statements to anyone about possession of his gun.

You will need a copy of his death certificate (they have to have it for file) to take with you. Tell them the gun was packed away because no one was interested in it and didn't know what to do with it, so it was packed away. You are now of age and would like to register it to you. You will need to get a purchase permit while you are there.
There are a couple of questions:
Are you sure it was registered in this state?
Do you have his "safety inspection" green card?
With the repeal of the green card, you shouldn't have to take the gun in..unless;
you don't have his green card and they have to verify the serial number.
This I am not sure of.
When I took possession of my brother and my dad's handguns after they died, I had the green cards and did not have to take the guns in.

DO NOT...under any circumstances carry this gun until it is registered to you.

If you are required to take it in, place it in a container, unloaded and in your trunk.

It's really a very simple process, been through it three times. The only thing you have to keep in mind is the possible loss of the gun if something unknown pops up.
As in another thread where a guy was wanting to get his dad's 1911 registered. Unfortunately, it was a government issue. I suggested to him, he must face the possible loss of the gun as being stolen military property.
I have found guns in vehicles back in my junk yard days and have never had a problem turning them in. One was cleared and I had it registered in my name.
The others were taken and to my knowledge destroyed; they came back stolen is all they would tell me. I was never under any chance of arrest (as I was told by the detective) because I told where I got them and turned them in voluntarily.
Much the same as the "gun buy back" no question amnesty.

No need to lie:p.Tell them that you just found the gun after going through your father belongings. Box was tuckled awy in storage for all these years and you just found it yesterday.

Posession of an unregistered firearm is illegal in Michigan. You know what they say, ignorance of the law is not an excuse unless youre a cop. Or maybe a prosecutor, or gun board member, or .......

As long as he has not carried or transported it for 18 years, he has not been illegal. It is a registered firearm, and can therefore be carried by a person with a CPL.(unless the passing of the owner nullifies the registration, of course. I'll admit, I don't know that) Possession in the home is moot.

He said the gun was registered and has been in his house; so it's merely a transfer of ownership upon the death of his father. Time isn't really an issue, he can say he just found it in his father's belongings that were packed away.

This really is not that big of an issue, believe me, been there 3 times, no problems.

I was using the reference to the test as more of a statemrnt to credibility. Im sure that with it appearing on the test that there is a rule of law to back it up.

I do understand and agree with you however.

After thought, I must correct myself.

You also would be correct if an leo was able to establish a time line; if he were to give a specific date when the gun was found. Then yes, they would probably confront him with the 10 day registration clause as used in the purchase requirements.

After posting on the forum, it is an issue he needs to take care of as soon as he can.
