Asked to leave McDonalds at Charleston and Town Center

I stopped by the McDonalds at Charleston and Town Center tonight to get the kids a dessert and after discussing the options with the kids i stepped up to the counter and was greeted with the following:

"Sir can you please hide your gun"
No i do not have a permit to do that.
"Then you will need to leave, they may see you on the cameras and think you are trying to rob us"
I can assure you i am not and i have been here many times with my firearm which is perfectly legal
"You will have to leave"
Is this your policy or is it a corporate policy
"Its uhh corporate"
Then i need the number for the owner

All while wearing one of my bright yellow Gadsden flag t-shirts.

Left a message for HRL at 838-2955 and will see what the response is.

This is the McDonalds that is in the same shopping center as the Del Taco another member had a MWAG call.

Seems like more and more places are rejecting open carriers ...what the hell is going on??? Maybe I am just being a drama queen about it, but it seems like we're being cornered day after day due to common ignorance, how can we educate those or find a source of media to educate others about Nevada being an open carry state, I mean come on ...this is getting rediculous!

A private business has the right to tell me that I'm not welcome, for any reason they choose.

I have the right to try to get them to wise up. If it doesn't work, well, there aren't many businesses without competitors . . .

As far as I am concerned, any business which requires me to give up my means of defense is taking on all liability for my safety while I am there.

Got to love competition in business. Some grocery stores have decided that they don't want thousands of dollars annually from my family and hence another grocery store gets thousands of dollars annually from my family. It turns out that their competitor had lower prices too. Nothing like giving a customer the boot to make them consider looking at the competition.

Seems like more and more places are rejecting open carriers ...what the hell is going on???

More people are carrying into more places, creating more opportunities for an irrational anti-gun shop owner to encounter a lawfully and openly armed citizen.

I think most places don't have an issue with it as long as you are a paying customer and not acting like an arse. With further education however, I'm sure we can win over the minds of most of the places that reject guns.

The root of their problem is a lack of understanding. As more people carry openly without causing problems, the public will learn, by seeing it with their own eyes, that it does not lead to mayhem when people are carrying guns.

IMO you should have immediately asked to speak to the manager, politely.

Similar thing happened to me once and was favorably resolved on the spot. Nothing to loose and everything to gain.

I have found over the years that people are becoming more fearful of people carrying guns of any type.
People have known for yeas a hand gun was designed for one thing, to shoot other people with…..
I have found people just don’t want to be around when some idiot pulls a gun and starts shooting….the gangs and bad guys have really screwed things up….
I have seen this escalate over the last 45 years…:?

I am a firm believer that how I dress and trying to show a first impression of confidence has a lot to do with how comfortable the public is with my open carry. Wished there was a way to test this theory. I have to admit I was wrong once before however realized I was in error.

im guessing you probably dress up and clean shaved and are older? i know how we can test. maybe you go somewhere and see what they say. and someone on here like me (one of the younger guys) who has tattoos and dresses like a "punk" some might say. will go to the same place and see what happens

Not saying that it is right, just or moral, but other people's perceptions are part of the reaction equation. Just another reason to educate everyone we can.

The only thing that should count is the behavior of the person - what they are or are not doing.

You are really pushing it by not leaving when told to do so - this kind of stuff going to get you or somebody else caught up in a tress pass charge soon - needs to stop.

here is the tress pass 207.200 statues, when I used to work casino security we had to read of a paragraph wich I used to have memorizedso it might not be exact, also I dontthink they have to quote it exactly but basicly say you are tresspassing and to get theF?ck out

As a Duly appointed represenitive of the owner of this property I here by warn you are tresspassing upon this property as defined by nrs 207.200. If you do not leave these premise immediately you will be subject to an arrest for a misdemenaor your subsequent return to the property after being duly warned not to return will subject you to a immediate arrest for tresspassing

NRS 200.603, any person who, under circumstances not amounting to a burglary:

(a) Goes upon the land or into any building of another with intent to vex or annoy the owner or occupant thereof, or to commit any unlawful act; or

(b) Willfully goes or remains upon any land or in any building after having been warned by the owner or occupant thereof not to trespass,

Ê is guilty of a misdemeanor. The meaning of this subsection is not limited by subsections 2 and 4.

2. A sufficient warning against trespassing, within the meaning of this section, is given by any of the following methods:

(a) If the land is used for agricultural purposes or for herding or grazing livestock, by painting with fluorescent orange paint:

(1) Not less than 50 square inches of the exterior portion of a structure or natural object or the top 12 inches of the exterior portion of a post, whether made of wood, metal or other material, at:

(I) Intervals of such a distance as is necessary to ensure that at least one such structure, natural object or post would be within the direct line of sight of a person standing next to another such structure, natural object or post, but at intervals of not more than 1,000 feet; and

(II) Each corner of the land, upon or near the boundary; and

(2) Each side of all gates, cattle guards and openings that are designed to allow human ingress to the area;

(b) If the land is not used in the manner specified in paragraph (a), by painting with fluorescent orange paint not less than 50 square inches of the exterior portion of a structure or natural object or the top 12 inches of the exterior portion of a post, whether made of wood, metal or other material, at:

(1) Intervals of such a distance as is necessary to ensure that at least one such structure, natural object or post would be within the direct line of sight of a person standing next to another such structure, natural object or post, but at intervals of not more than 200 feet; and

(2) Each corner of the land, upon or near the boundary;

(c) Fencing the area; or

(d) By the owner or occupant of the land or building making an oral or written demand to any guest to vacate the land or building.

3. It is prima facie evidence of trespass for any person to be found on private or public property which is posted or fenced as provided in subsection 2 without lawful business with the owner or occupant of the property.

4. An entryman on land under the laws of the United States is an owner within the meaning of this section.

5. As used in this section:

(a) “Fence” means a barrier sufficient to indicate an intent to restrict the area to human ingress, including, but not limited to, a wall, hedge or chain link or wire mesh fence. The term does not include a barrier made of barbed wire.

(b) “Guest” means any person entertained or to whom hospitality is extended, including, but not limited to, any person who stays overnight. The term does not include a tenant as defined in NRS 118A.170.

Thanks. Although I am not sure that staying the extra few seconds Adam did to find out if it was corp policy or not would be a tresspass.

well it would be up to the manager and if he/she/it gave anyone else permission to trespass wouldn't have to be a corporate decision unless it was a corporate store and they had a policy that states the manager couldn't make that decision.

I Was at the California hotel meeting some friends and my gun printed through my shirt (cant wait for mycrossbreed super tuck holster to get here)and security was all over me saying i was breaking the law because no fire arms were allowed but they only have one small side entrance with a very small no defending your self sticker and I pointed out to the cops who got there (by bringing up the law on my iphone) that all public entrances must have a sign stating no firearms or a metal detector (the main entrances and the garage elevator which is how i entered had no signs )and they let me go but security didn't trespass me but just say you better get out of here now with that gun and my reply was I was on my way to when you stoped me

Just an FYI...

In NV, concealed carry is only prohibited at PUBLIC buildings (government offices, etc) that have been posted. In PRIVATE establishments (shops, casinos, hotels, banks, doctor's offices, etc) posted signs carry no weight of law whatsoever. So, even if every entrance was posted, you still wouldn't be breaking the law.
