Thread: New to Charlotte

    I thought I would lose my forum virginity today by asking a quick, probably easy question. I understand that open carry is fully legal throughout NC. I have read in multiple places on this site, however, that local government can impose further restrictions? Is this correct? I am moving to University area of Charlotte next month and want all of my facts straight ahead of time! Last thing is to find out if there is a regular meeting group in the Charlotte area? Thank you so much!

    I believe the only places that have regulations against open carry are Cary and Chapel Hill.

    Welcome to the forum!

    We have an open carry meet in the Charlotte area coming up soon. There are also meets in other areas around NC, so keep an eye on the forum.

    Ok thanks a lot. Although my wife and I will have to miss the June one, we are moving middle of July and so from then on out it sounds great. Oh another question, I know places such as schools, federal buildings, banks, concerts, bars and few more are restricted but what about like Uptown and other "downtown" type places?

    Check the door for signage. You will be surprised to find that you can't conceal carry in a few places, but you can open carry freely. For example, banks: state law says you cant *conceal* a gun while in a bank. whats that mean? You can still open carry in a bank, as long as its not posted.

    As for concerts, NC law states that you can't carry wherever an admission cost is present, such as movie theaters, concerts, etc etc.

    NC has one major statute about carrying in restaurants though: you can't carry anywhere that anyone can purchase *and* consume alcohol. that means you can't go to the outback steakhouse with a gun strapped to your hip because they serve and consume alcohol there. If you go to a supermarket, you can pick up all the beer you want while OC'ing, and your good to go, because your not allowed to *consume* alcohol while at a supermarket.

    Ok so public streets and sidewalks and all are fine. Good. I also have read that it is illegal to carry, open or concealed, with any alcohol in your system whatsoever. True?

    very. If you drank, smoked, snorted, ate, or injected anything into your system that can hamper your judgement even the slightest, then don't carry, period. it'll not only make us all look bad, but it can land you some serious jail time.

    And yes, public street and sidewalks are fine, provided your not in Cary (I don't know the law there, so someone else can cite for me, that would be awesome)

    Ok that's why I thought. Yea I can see how that could look real real bad. Although I use this forum to do my research I would like to know where I could actually find the open carry laws so if a problem arose I would know where to reference.

    There are really no "open carry laws", The law books say what you can't do.

    there is a pamphlet type thing that would help let me find it and post the link here.

    Most towns have ordinances against display of firearms. check municode to be sure. They usually only apply to city property.

    There are no laws against open carry while under the influence of alcohol. The statute against carrying while drinking is for concealed carry.

    It shall be unlawful for a person, with or without a permit, to carry a concealed handgun while consuming alcohol or at any time while the person has remaining in his body any alcohol or in his blood a controlled substance previously consumed, but a person does not violate this condition if a controlled substance in his blood was lawfully obtained and taken in therapeutically appropriate amounts.
    Now, I am quite sure that creative charges can and will be levied against you if you open carry while plastered. But it in itself is not illegal.
