Lawsuit on the strip that may help us.

I'm missing something...was Darth Vader carrying a .45 or something? I fail to see how this is going to help us. It appears the Venetian security staff believes because the county makes them responsible for the cleanup of the sidewalk that it became their private property that they can trespass people from for whatever reason. This doesn't surprise me considering the random acts of stupidity committed by Venetian security over the years. Too many casinos think that whole chapter of gaming law about "detain a violator for the purposes of notifying a peace officer" makes them a private police force. Unfortunately if you read NRS 465.101, it only allows them to detain someone suspected of violating Gaming Laws aka Chapter 465. If they tried to detain me we would have a serious problem. If they told me to leave the sidewalk, I would simply walk away.

although not directly related to 2nd amendment I do see how this would help us as its a case of what is public property and private property on the strip. These hotels and casinos seem to think the public sidewalk belongs to them. This case will further help the OC movement when we organize a strip walk. Or just a person walking down the strip that values his self defense and not be trespassed from a sidewalk.

Public or Private, what those "cops" did was a gross violation of civil rights. No way II'm going to comply with some security guard to be detained and have his hands rubbed all over me.

What you can expect from $ 9/hour security, beside ignorance and a poor service they are providing. In 2007 I was in the New York New York casino at the time of theshoothing and laugh seeing the security running and hide all over, closed themself in themain cage vault. But no, honest people can't defend themself's and the family let's wait for metro to show up after they finishthe coffeand some random security. I called oance the proprety security where I live: Surprise we are notcover your community over the week-ends.....So officers just please read and apply the law in the right way,being a model for the citizens that you are out there to protectin good and bad wheater conditions.

Then you newbies dont know about Tim and how he was treated just off the strip. You newbies also do not seem to have a grasp of how the police in this town think they can violate whomever they wish. Once Vader wins this case and I 'think' he will. Maybe the police will understand they cant run people over any longer.

As usual, difficult to 'judge' a case based ona single newspaper article. But the case does appear to have merit.

And I do see the relationship to our cause.

I'm well aware of Tim's story and what happened. In this case, the characterswere (wrongly IMHO) detained by private security on public property to wait for Metro to arrive so security could issue the trespass warnings and 86 them permanently from their private property, even though they were on public property when security encountered them. They should never have been detained by security since they were on public property, which is where their lawsuit should be directed.

Security stopped them. Security handcuffed and detained them. Security moved them to their detention room. Security held them there until Metro arrived. The amount of time it took Metro to arrive is irrelevant. The only place I think Metro stepped in it is where they didn't inform security or the brothers that the sidewalk is a public place and they may go there as they wish. Not that this would have stopped security from 86ing them from the hotel itself, since they can do that for any or no reason.

I still don't see how this helps us. Do you think a lawsuit like this is going to win us points with the Venetian? That they will suddenly welcome open carriers with open arms because security hassled some street performers and got them sued? I'm not making the connection and I doubt the hotel management will either.

Steve, I promise I'm reading the same article you are. The suit against the Venetian and Metro are one and the same, I'll find the case info later. All Metro did was witness them give the trespass warning so it goes into SCOPE in case they're found on Venetian property at a later date. As for the security guards, this was their baby, not Metro. Tim's situation was all Metro.
According to the lawsuit, Jason Perez-Morciglio was throwing away trash in front of The Venetian on Jan. 15 when security officers "kidnapped the brothers, forced them into a small room inside the Venetian Hotel and detained them."

"These security guards handcuffed the brothers, searched their persons and belongings, demanded identification, and photographed them," the document said.

"Each of the brothers was strapped to a chair and kept by the security guards for over an hour."

The lawsuit alleges that the security officers then summoned two Las Vegas police officers who handcuffed and searched the brothers before directing them to sign misdemeanor trespass warnings. The police officers were identified only as S. Schaier and T. Scott.

"Thereafter, the brothers were escorted from the premises to the parking lot in the back of Harrah's Las Vegas Casino by the security guards and were warned not to 'trespass' on the sidewalk in front of the Venetian Hotel again or else face arrest," according to the document.

From the third paragraph of the article.

And from later

So yes same suit but metro is a part of it and it does have implications to us who walk the strip or any public place in this town that metro feels they can bully.


the thugs at metro did more than observe.

Whats being failed to realize is these people were NOT on Venetian property. they were on a public sidewalk in front of a building. which is NOT owned by the hotel. The gang bangers we call metro were in the wrong, the Venetian was in the wrong. both parties violated civil rights that are guaranteed by the constitution. This correlates to OC not that this casino is going to magically welcome us into their buildings. BUT, to tell them they cannot take control over public places such as the sidewalks! how is that not connecting? This has happened time and time again to normal every day citizens. the Venetian has no legal rights to trespass them from a sidewalk that is public property. from the story these people were never even ON the Venetian's property. OC is not just about guns and carrying them. its about defending and exercising our constitutional rights!
