Well, the DA is responsible for prosecuting the cases generated by the Sheriff. If the sheriff creates a case that the DA won't prosecute because the sheriff didn't understand the law, then you have a case for wrongful arrest and can attempt to bankrupt the Sheriff's department of that county. You can talk to the DA today and find out HIS stance, and he WILL talk to you, whereas the State AG can only get involved if someone holding office writes him a letter (like say, a County Commissioner not up for re-election, a member of the local school board, etc. -- someone who won't be "hurt" by asking questions).

And if the Sheriff never makes the arrest there is nothing to prosecute.

I would rather avoid the ride and stay broke than take the ride (or worse) and cash in on a suit.

The officer can only take the handgun "for officer safety" if the stop was lawful. Or does the sheriff think that every time one of his deputies says, "Good morning," to an armed citizen, he can take the handgun "for officer safety"?

If the deputy does not have RAS to make a lawful stop, he needs to keep his paws off the gun! Period!

Yep, but the sheriff wouldn't comment any more. Sooooo... I guess someone may find out one day how it goes up that way.

This is pretty aggravating. I guess I was just one of the sleeping sheeple all these years. I put way too much faith in our elected officials and now we have these guys in power who will do pretty much what they please. I am glad I woke up!

One thing obama was right about...CHANGE! Not his version of course!

I know there is alot of negative we can still focus on here but hey theres a couple bright spots. They removed the misleading info from the page and at least he is aware now we are here and has informed his crew that we are here. Maybe it'll make for a better encounter when it happens. As for how they handle approaching an OC'er, thats a new battle :)
