Need Help In Long Beach LBPD ROUND TWO

Tonight at the town center in Long Beach Police cuff and detain me again for over half an hour. Coming out of Barnes and Noble an officer named Gonyea yells at me to stop and put my hands on my head. I comply. He orders me to my knees and takes my gun and ammo away. Second officer has gun at low ready. They let me up and started asking for ID. I asked the officer if he was demanding my ID or Asking for it. He replied asking so i politely declined. They then said they would arrest me for violating Penal Code 12031 by not giving my ID. cuffed and thrown in a car for 25 min.
Get me out of my car and tell me they knew who I was because one of the Park Rangers from July 4th showed up and IDed me. I asked to have my gun and ammo back and got some names before walking away with gun and ammo.

We need a meet up in long beach to help the LBPD understand our rights. Wife has all on video. 28 min need to know how to edit it down to under 10 min to upload.

Awful.

You're doing a great job though, friendly witness, getting everything on video/audio. You're doing great...it's your police department that's sucking it up.

I don't know what to say though beyond that. I really think now is the time for a lawsuit, you have two instances now that you've been unlawfully detained in Long Beach. You have ample evidence in both cases that your fourth amendment rights were violated. I'm dubious that these violations of your rights will stop unless the officers and/or departments involved are sued for damages.

Yes I would say that a meetup is in order. Something on a larger scale than an individual carrier may teach them something. Maybe that needs to be next month. I'll be watching for it or let me know and we will attend.

Pretty sure your detainment in this case rose to the level of de facto arrest. 25 minutes, cuffed and stuffed in a patrol car is an arrest. You need to contact the guys at the Calguns Foundation (not the Calguns.net forum, different entities) and attorney Jason Davis.

12031 has nothing to do with identification and unless you had ammunition attached to your firearm in a position to fire, there wasn't anything to arrest for.

Since they, like their Park Ranger bretheren. have detained you longer than was necessary to inspect for loaded condtion, are increasing the department's liability, should a 1983 lawsuit arrise.

I do not agree that this is the time for a 'meet up'... (not in the sense that most here are thinking.) There should be widespread activity, but not in the same locations or at the same time. Bigtoe416 may be right- this may only be eliminated with litigation, but in lieu of that, is changing their 12031 enforcement policy with plan "V".

Be Careful out in Long Beach

If the rank and file LBPD officers are obviously not getting the OC training memos..... I guess it is time for an attorney to 'serve" them one via Federal court. Sorry to hear about your latest detention, but it is time to act with legal action before you get hurt. 2 detentions in two weeks is nuts in the same town. Be really CAREFUL because I am sure they would like to trip you up saying you were in a GFSZ, or were LOC to help negate their previous bad conduct. Don't be so naive to believe they are all honest boy scouts and will always tell the truth. Most will, some won't.

If I were you I'd notify your nearest FBI office of the two incidents. It seems a pattern may be forming. The FBI has the ability to investigate and criminally pursue any abuse of authority under color of law. Nothing may come of it now, but if it keeps happening you may get some help from the feds.

Also get in touch (and keep in touch) with the ACLU about this. I understand the CA ACLU hasn't proven to be very pro-gun in the past, but now that the 2A is a recognized right, they may be willing/obligated to help. At the very worst you'll waste 15 minutes of your time and have some elitist gun-grabber attorney tell you off.

We don't live our lives to be violated. If you are a free man, live and act as a free man! You gotta "defend yourself" to ensure tomorrow is a day with a little less oppression and a little more liberty. Otherwise, all you are doing is to exercise and reinforce unlawful behavior; making the world a little more difficult for the rest of us.

It is a good thing that you don't open carry. If I were a cop I would definately stop a troll with a gun.
Do trolls have to carry identification on them?

WoW I just got back from Colorado for vacation. LOC every place I went. Stopped at state line for gas, LOC when a security guard asked if my gun was real. I said yes and he said he was not sure if it was ok inside primm casino. I said my family and I were on our way out and asked if he would like to escort us out, as two guys with loaded guns was better then one. He laughed and said no need, have a good day. At the bass pro shop just outside the strip I walked in and the greeter asked if I had a CCW. I informed her that I did not have a gun concealed, that I was practicing LOC legally in NV. She said no LOC in the store, it's policy. I informed her I would not spend money at a store that restricted people from exercising their R2BA. I left and called the store manager from the truck and he informed me that it WAS ok to LOC in the store, just as long as it stayed holstered. He met me at the door to explain the correct policy to the greeter, who apologized. I had a great time and learned alot.

In Utah the gun can be Carried loaded as long as it is two actions away from being fired. Full mag empty chamber. Revolver set to next round empty.

Update: talked to Sam Paredes from GOC to see what if anything should come next.
