Handcuffed at Manito Park 7/24/10

Today we had my wife’s baby shower at Manito park in Spokane I chose to OC. While everyone was setting up I was watching my son play at the playground. After about half an hour I saw a cop creep by so I knew I was going to be contacted. I called my mother over to watch my son because I didn’t him to run off while I was talking to the cops. Sure enough he got out and motioned me over, he took cover half behind a tree. I said I’m guessing you are looking to talk to me and he said yes. He told me to put my hands on my head and sit on the bench that I was next to he came up from behind me and handcuffed me. He aggressively took me back to his car where I sat on the hood. He tried to lecture me about scaring people which is funny because I pointed out that the other 300 people at the park didn’t seem to mind as they went about their business. He told me that he would have me escorted for trespassing in the park by park security because of the city ordinance that prohibits weapons at the park. I explained preemption and he said I was wrong he said that it states that the city can be more restrictive not less, I laughed. I would have pushed it but I really didn’t want to miss my wife’s baby shower so I concealed it for the rest of the time and they let me on my way, I was not cited for anything. My mom saw the whole thing and she said she was absolutely appalled at the way they handled it and she hates guns. That wasn’t the end though about an hour later the same cop came creeping by and about five minutes later two other cops stopped in the parking lot by the pavilion were checking me out which I feel it was harassment and I have about twenty people as witnesses who agree. I feel so low right now so violated. I will be filing a complaint with the department and meeting with my attorney to look options. What almost had me laughing the whole time was the fact we will be having an OC bbq in a week and a half with tons of people that will be OCing in the same spot. I will still be OCing for that event.

Am I being detained? Were you? Or were you just getting screwed with. I know it was your wifes baby shower...but....whatever.

Go file a complaint, this could be a project for you.

They said, "your are being detained."

This is not the first issue I have had at this park. I will be taking this as far as I can.

Pretty sure that being handcuffed negates the need to ask if you are being detained.

Maybe since he just seemed to willingly comply with it, the officer just went ahead with cuffing/detaining without having to worry about a valid reason and such. I'm just saying, that question might have made him stop for a second.

What you think I said yeah go ahead and forget my civil liberties? How else are you suppose to act when a cop is detaining you. Should I run from the cops like a gangster in a cop’s episode? (I’m being overwhelmingly sarcastic). Come on man use a little common sense I was telling him the whole time that this was a violation of my rights but I figured I wouldn’t even have to mention that.

Do you carry a voice recorder or video recorder? I know you have witnesses, but being family they are biased. Are there other witnesses to the event?

Is there a 2A or 4A attorney over there that you can work with?

Also, always verbally refuse a search or detainment but never physically resist.

I dont carry a recorder, maybe I should start.

I have worked with John Clark of Crary, Clark & Domanico Spokane, Wa, a criminal defense attorney that I have worked with in the past with a carry issue at the same park. I was referred to him by the NRA.

I did voice my concern for my rights the entire time, I would never physically resist a cop.

This should be the first step in resolving this issue otherwise if you go looking for a fight well you will find one and the issue is to get the City to comply with State Law.

Get a recorder. Get ahold of the attorney.
It seems that you need to follow through and stand up for your rights in this circumstance.

Fetch & BobR have talked to the City Attorney several times.

Bennie you were detained unlawfully and once again you did a great job the way you handled the situatiion. Never resist a LEO unless your life is in danger. Its time to make this stop, the 4th will be a good start.

Good to hear reasonable attempts have been made to correct this and by the out come of the Silverdale picnic hopefully this will result in positive outcome as well.

Hopefully someone will bring a video camera to video if or when Police decide to ignore State Law.

Actually they never touched my weapon which shows me they were less worried about me using it than they were about showing me they were the boss!

Yes they ran my ID and checked my CPL.

Priceless lol they cuffed you but did not take your weapon :lol:

This sounds like ROOKIE to me :lol:
