    Post Non-Citizens and Firearms Possession

    In Short:


    • Resident Aliens (green card) may possess a firearm after 90 days of residency in the same state.
    • Non-resident Aliens (non-immigrant visa) may not possess a firearm UNLESS:
      • They possess a hunting license or permit
      • It is on loan for a lawful sporting purpose.
      • The firearms are to be displayed at a trade show.
      • The firearm is an Antique or replica that is:
        • A Muzzle Loader.
        • Chambered for a defunct round.



    This is a basic outline. You are responsible to make sure you comply with Federal and State law.

    Non-immigrant Importation of Firearms

    In Short:

    To temporarily import a firearm or ammunition into the United States, You must present the Customs and Border Patrol with:

    • A valid and current Hunting License from any state, and either:
      • An already approved ATF Form 6 NIA (5330.3D)
        • Takes 6-8 weeks to process
        • Must provide a valid Hunting License at time of submission.
        • Must provide proof you are exempted (see possession above)

      • Be a Canadian driving through the US as a shortcut to a destination back in Canada.



    This is a basic outline. You are responsible to make sure you comply with Federal and State law.

    Non-Immigrant Firearms Purchase.

    In Short:

    A Non-Immigrant may purchase a Firearm in these circumstances:

    • They have an Admission or Alien number. (You may need to request this from Customs and Border Patrol upon entry to the US) Plus one of the following:
      • They meet the lawful sporting purpose exemption:
        • You must purchase the Firearm in a state in which you have 90 days residency.
        • You must have a valid Hunting License from ANY state.

      • They receive an exemption from the Attorney General of the United States. (Good luck!)
        • You must have been in the states for 180 days prior to submitting a request.


    • They do not take possession in the United States. (You would have the FFL ship it to your home country)


    This is a basic outline. You are responsible to make sure you comply with Federal and State law.

    A Non-Immigrant Alien has the following restrictions on possession of a firearm:

    • Can not obtain a Virginia Concealed Handgun Permit.
    • Can not possess a center-fire weapon with any of the following features:
      • Can accept silencers
      • Has a folding stock.
      • Has a magazine holding greater than 20 rounds.


    This is a basic outline, you are responsible to make sure you comply with Federal and State law.

    YES, first post and I'm humbly thankful for this community and proud of those who lawfully pursue our God given freedoms and liberties. Thank You to you specifically for your reply, I'm glad the topic sparks your interest.

    I understand if you don't yet realize my claim. The site is more of an introduction on the subject. How far down did you read? Did you get to the "Guns" and 2nd Amendment section? Here is a site that is more specific to my claim; http://www.state-citizen.org/

    I had interest until I clicked the link. I was turned off by all the tin foil and the lack of relevance to the subject it purported to address.
