    Park Carry

Alright, as I understand it, it is now legal to OC into a city park. Previously it was (theoretically) ok to OC into a city park if one had a valid CCW...but now this should be a moot point as the permits are not required and CCW is preemted by the state?

    Am I correct?

HB 2543 (effective 7/29/10) strengthened firearms preemption and was specificially aimed at getting rid of the city parks ban on non-CCW carry.

By the way, AzCDL's August newsletter has a summary of all the key gun laws that were passed. Check it out: http://www.azcdl.org/html/newsletters.html .

Bear in mind that if you are in a city park that has a posted sign and are carrying in violation of a now preempted city ordinance, it's possible a local cop would arrest you under the city ordinance, if it hasn't been repealed. After a few thousands of dollars in court costs and attorney fees, you'd probably win.

The smarter move would be to see if your city still has the park ban on the books and start working with the city to repeal the ordinance.
