What a fun quiz! I had to think about some of them.

I was at the April 2A rally and the CHP swat e-checked us. The CHP said I could UOC on and around the Capitol without ammo. I did with my wife and the CHP as they walked other rallies. I'm glad that LE are clueless about the law.

Well I don't live in California, I got 50 out of 100, so not ready. That's OK I would never visit California and I will not buy things from businesses in that state until it changes it's gun laws or goes bankrupt.

Well after the official Los Angeles and San Diego boycott of Arizona by your elected officials I have a less than positive view of the entire state. While my dissatisfaction is directed mainly at the government of California , got to remember who put them in power, so subsequently I will not contribute, if I can avoid it, giving any money that my benefit that state in any manner.

I see, I've been doing it wrong by helping to support the efforts in neighboring states. I guess I should stop my annual $1,000 donation to AZCDL. Especially since you guys keep re-electing John McCain...afterall, he'd be right at home as a politician here in CA.

You have violated California Penal Code 626.9. The Gun Free School Zone law provides an exception for being armed if there is a restraining order against the aggressor. It does not provide an exception for fearing for your life. However, the law restricting the carrying of a loaded firearm does provide an exception for that.
FUD. 626.9 provides an exception for possession on private property. People v. Tapia, 129 Cal. App. 4th 1153 (2005), held that a sidewalk did not constitute private property because the public held an easement on the sidewalk, which meant that the sidewalk was not exclusively private property. Tapia’s holding does not apply to driveways, over which there is no public easement. Your reference to fences is irrelevant because Tapia expressly considered and found inapplicable the "public place" definitions which your reference to a fence implicates. Moreover, the question does not state whether the handgun is holstered or in your hand – thus the question is ambiguous as to whether brandishing is a factor to be considered. The restraining order exception you identify allows a person to possess a firearm within the GFSZ even if the person is not on private property, in a residence, or in a place of business. Thus a person who reasonably believes he is in grave danger due to circumstances that led to the issuance of a current restraining order may escort his children onto school grounds while carrying a loaded firearm without violating section 626.9. Of course, reasonable belief is an issue of fact, so you can be arrested and prosecuted. So, not a good idea.

Carrying a replica firearm is unlawful unless it is obscenely colored and is obviously fake. Blue plastic guns for defense training are a great example of what would be lawful to carry.
FUD. Poorly written question. Where? You’re telling me that my children cannot carry realistic looking cap guns in the home or in the backyard. Penal code section 12556 states that “No person may openly display or expose any imitation firearm, as defined in Section 12550, in a public place.” Accordingly, if you are not in a public place, openly carrying a realistic replica is fine. As already mentioned, carrying a concealed realistic replica is not prohibited. Furthermore section 12556 includes numerous exceptions (e.g. theatrical exhibitions, carrying with a permit in parades and fairs, carrying in areas where firearms may be lawfully discharged, etc.) which your question does not exclude. One of your questions was that “You can carry a loaded handgun in California.” Which is true in some, but not all places, in California. The same thing is true with respect to replicas.

I just watched a vid of the meetup at the Redondo pier. In the vid the police were escorting people through what the police call a prohibited area.

In my post admitting to a criminal act I stated I was with the CHP when committing my crime. I posted my crime to illustrate how clueless even LE are on the laws.

I think this test was FUN and every one who has a gripe should make there own test. No the quiz is not prefect but it gives a general idea of what people need to study.

I think people's comments are far more about about refining the quiz then simply abject griping. I can say with certainty that's what my criticism was for...

All around great points. I think I've made that same mistake regarding 626.9 before. I'll update the quiz sometime soon to reflect the latest suggestions/comments. I appreciate everybody pointing out where the quiz is lacking or just flat-out incorrect.

Our elected officials are putzes for the most part. And in case you hadn't noticed they have been doing things that the electorate here doesn't agree with, hence there will be some backlash on Nov. 2. Most polls show a majority of the actual citizenry in Los Angeles and San Diego agree with Arizona. However, in LA you have a Hispanic mayor who has his own ideology that is taking precedence. In San Diego, where I live, we have a RINO in Mayor Jerry Sanders who has ignored the desires of his constituents on a number of issues lately. He's another that could care less that the majority of San Diegans polled support AZ. Heck man-- we're right on the border too and we understand. About two years ago Sanders presented a plaque to La Raza and proclaimed it La Raza day and pushed it through a city council meeting BEFORE opponents could make arguments against it. San Diego city government is a bad, bad dream that we can't wake up from. We're nearly bankrupt from city employee unions buying council seats and then giving themselves obscenely generous and unsustainable pensions. Seriously-- don't think our city government speaks for a majority here. :(

I got tripped-up on the HSC question; however, you are correct as "organic" carry is best. HSC is an ID card.

Other than that, I flew through the questions and consider myself well versed.

Hello All,

The school portion of this question was a miss-direction play.

A person may not place themselves in harmsway to protect a piece of property. If you are in the car and somebody tries to car-jack you, you are in imminent danger of being killed or hurt; therefore, you may protect your car and PERSON with lethal force.

If you are in your store and somebody tries to loot your store during the Rodney King riots, you may protect yourself and your store. Civil unrest gives you more leeway to protect property.

If you are safely in your house, and a car thief is stealing your car, you may call the police. If you run outside and shoot the bastard, you will probably be prosecuted on several charges.

Remember, you can only shoot somebody who FORCIBLY enters your house. However, if the person walked in through an open door or window and then starts to rape your daughter, boy, or wife/husband, then you may shoot the BG.

There must be a threat to your life or someone elses life before you can protect property.

I had one of my work trucks ripped-off. I asked the cops what my options were if I had caught the bastard in the act. They said call the police. Legally, that is the best option. Personally, I would have used the three "S" theory. Ripping off a man's tools is like ripping-off a man's life; tools are his livelyhood.

You can attempt a citizens arrest, but if the BG goes violent on you, you may face charges because you placed yourself in harmsway.

My advice: Go to the closest window while remaining inside the house with a loaded gun and an unloaded gun (no mag or ammo attached). Next scream-out "I AM GOING TO SHOOT YOUR ASS" and then rack the slide on the empty gun*. When the cops come, don't tell them anything about the guns. If they ask, lie.

Am I screwed-up on this issue?

* Note: I used this method once, and, IT WORKED REALLY WELL! THE PERP HAULED ASS! That distinctive sound at 0200 hours is actually quite loud. According to John Lott, about 80% of the time, the mere presence of a gun thwarts a crime.

Unless you are Theseus, in which case, the privately owned laundromat does not qualify as private property for the purposes of your conviction.

I would not lie to the police. You have the right to remain silent. Use it! I would not suggest racking the slide on an empty gun. rack it once and hope they hear rack it twice they know your empty. Leave this to the movies.

You used better terminology re lieing to the police. By lieing, I meant keep your mouth shut. Always keep your mouth shut around LEO.

The courts have ruled that you may have a loaded weapon inside your fence line. If you have a front-yard fence that is say 42" tall with an unlocked but functioning gate, you are OK. This is a recent case from the LA area. I don't remember the name of the defendent. I will have to search for it. It is interesting reading.

So LUCC in a gun bag on the front seat in plain view is fine, LUCC in a locked mounted safe on floor is fine, but LUCC in a gunsafe installed in the center console is illegal??? Here is a good what if...what if the console wasnt bolted to the floor of the truck, it was portable and removable, does it still meet the definition of a utility box?

On its face does anyone believe these could be overturned or thrown out in court? (not that I want to be that case) With a huge what if scenario, pulled over by PD, for some menial traffic violation, "Sir may I search your vehicle", -no you may not-, "sir if you have nothing to hide, why wont you let me search" ...yada yada yada... my 4A is violated, im cuffed and stuffed, they search, they discover the safe, I refuse to answer questions, they force the safe...you get the idea.

Im thinking no RAS, fruits of the poison tree, no clear definiton of Utlility Box...

All those that respond, please dont blow this into some "dont be stupid and ruining things for all of us" rant. I have no intention of breaking or bending the law, just want some other peoples opinions and experience, for a discussion.
