Moving from San Diego to Fort Worth

So in the next few months i will be moving from san diego out to fort worth texas to help out my brothers family while he is overseas for a year and i need to find out what i should know about the laws out there specifically pertaining to firearms any help would be greatly appreciated.

General rules

1. Don't open carry.
2. You can CC in a vehicle without a CHL with a few stipulations.
3. Don't look back after you leave CA.
4. Don't buy a cowboy hat or a buckle you can eat off of until you have lived here for 3 years.

More basics!

1 - Carrying a handgun legally requires a CHL, and it must be concealed. Your own property and "while traveling" are your only OC options right now. Like TehGruu says, you can CC without a permit in your vehicle until you get your license (which will actually happen, unlike San Diego!) You can carry a long gun OC/CC without a permit as well, just be mindful of sheep in cities.

2 - No registration or AWB at all, unlike California. Bring whatever non-NFA stuff you want and keep it, then build three more AR-15's just because you can :cool:

3 - No state-level GFSZ laws or other Californian ridiculousness. No "safe handgun roster," no prohibitions on private sales, and plenty of gun shows held on government-owned property.

You're going to love it here!

You can carry in your vehicle anytime, anywhere. Just make sure it is concealed. Don't tell an officer you have it unless he asks. Must have a CHL when carrying on your person. You can carry it (with CHL) pretty much anywhere except bars and federal government buildings and court buildings.

Can anyone site the law on being able to CC in your car without a permit? And also i own several knives, swords and a couple batons here can anyone tell me whats legal and whats not?


Was trying to look up the penal codes and what not but some are confusing

By default, they're all illegal(the swords). Except you're allowed to keep them in your home as a curio. Dunno about batons.

(2) inside of or directly en route to a motor vehicle that is owned
by the person or under the person's control.

(a-1) A person commits an offense if the person intentionally, knowingly,
or recklessly carries on or about his or her person a handgun in a
motor vehicle that is owned by the person or under the person's
control at any time in which:
(1) the handgun is in plain view; or
(2) the person is:
(A) engaged in criminal activity, other than a Class C misdemeanor
that is a violation of a law or ordinance regulating traffic;
(B) prohibited by law from possessing a firearm; or
(C) a member of a criminal street gang, as defined by Section
71.01.
(a-2) For purposes of this section, "premises" includes real property
and a recreational vehicle that is being used as living quarters, regardless
of whether that use is temporary or permanent. In this subsection,
"recreational vehicle" means a motor vehicle primarily designed as
temporary living quarters or a vehicle that contains temporary living
quarters and is designed to be towed by a motor vehicle. The term
includes a travel trailer, camping trailer, truck camper, motor home,
and horse trailer with living quarters.
(b) Except as provided by Subsection (c), an offense under this
section is a Class A misdemeanor.
(c) An offense under this section is a felony of the third degree if the
offense is committed on any premises licensed or issued a permit by
this state for the sale of alcoholic beverages.

That by definition means i can own them(swords, batons, and certain knives) but i cannot carry them on myself while off my property? And i cannot open carry it must be concealed while in my car "in travel"

That is what I believe the law says. Though IANAL and I have not heard/seen any cases of officers finding 'illegal' knives in people's homes. So I have no idea what they would do. I think it's retarded and would love to see it removed. The batons you should have no trouble with at all, though as long as you don't carry them off your property.

You don't have to be traveling in your car to have a gun in it. Like, you're not restricted to simply carrying your weapon to and fro the range or a gun store for example. You can keep it in your car while shopping at the mall for instance, so long as the parking lot isn't posted.

The "illegal knife" definition including swords prohibits carrying them (openly or concealed), but not simply owning or possessing them at home. The same PC §46.02 exceptions for handguns, namely that you can carry a handgun without a permit at your home, or your own land, or in your car, apply to a sword, or a collapsable baton, or any other weapon mentioned in §46.02. The Harris County DA in 2007, Rosenthal, pitched a fit to the media about how people would be "killing each other with bowie knives" now that it was legal to carry large knives and clubs along with handguns in cars sans permit (Rosenthal was one of the main reasons the old presumption-of-traveling law was replaced with the current exception-based law for cars). Strangely enough, you could openly carry a sword or a collapsable baton in your car, but the handgun still must be concealed... logical.

The curio/antique definition is PC §46.05, "Prohibited Weapons", one of which makes it illegal to have a switchblade unless it's possessed as a collectable antique or curiosity. If you've got one of those, then maybe you'd have to explain its collectable nature even if found in your residence. A simple sword, however, is perfectly fine in your home.
