Video is fine, it's the audio that causes some problems.

Key wording in the statute:
“Oral communication” means any oral communication uttered by a person exhibiting an expectation that such communication is not subject to interception under circumstances justifying such expectation. . .

So it all depends on the situation. Are the people sitting there speaking in normal conversational volumes or are they huddled close together whispering? Also the method of capturing the audio is important. A typical video camera at some distance or a remote microphone hidden under their bench.
