We won.

The city attorney said basically that they had to follow the law even if they didn't like it, (like everybody else). :p Now the city of Royal Joke is trying to get a judge to put a TRO(?) or something to stop it next year, and trying to get the legislature to change the laws and definitions so that it fits their needs. They aren't likely to succeed with this either.

Here are a few threads about it, including another local city attempting a similar activity:

My take on where we are at (point in time "snapshot"):

1. The contract language was changed to remove "no firearms" by a 4-3 City Commission Vote.

2. Firearms were a "non-issue" at the festival, reported by multiple news organizations.

3. Royal Oak voted 7-0 on a resolution to have the State of Michigan ban firearms from all MI Public Buildings. While it holds no "weight of law", it has been forwarded to all municipalities in MI. It appears that this effort will go nowhere. The City of Berkley did a similar action. I believe this action was in direct violation of their Oaths of Office to uphold the MI and US Constitutions and have considered Recall and/or Injunction Activities (Jury still "out" on this).

4. Royal Oak voted 7-0 on a resolution to have the State of Michigan create a new Pistol/Gun Free Zone (PFZ) for festivals like Arts, Beats, & Eats. While it holds no "weight of law", it has been forwarded to all municipalities in MI. It appears that this effort will go nowhere, which the City Commissioners described it as "spitting into the wind". I believe this action was in direct violation of their Oaths of Office to uphold the MI and US Constitutions and have considered Recall and/or Injunction Activities (Jury still "out" on this).

5. Royal Oak possibly wants a judge to issue a Declaratory Judgment to have current PFZ's apply to the Arts, Beats, & Eats Festival grounds, despite specific MI Attorney General Opinions (7120). This has not come back up during City Commission Business, so I believe that this action is "dead in the water" and will go nowhere.

6. The Arts, Beats, & Eats Festival Grounds is an Open-Carry Alcohol Zone, which stops persons from providing for their fundamental right of self-defense if they do not have a CPL. This is possibly in violation of 1 Federal Law, 2 State Laws, and 2 Royal Oak City Ordinances. I have considered Injunction Activities to resolve the situation (Jury still "out" on this).
