Nevada DMV accepts open carry

This isn't the first time I've carried openly at the DMV.

I filled out my forms to renew my license, (I was required to do it in person because of my age), and came to the counter, he looked over my form and said it looked fine, and I got my number.

It was a short line, I was #G124, they were on G113 when I got it. Someone was talking to me about the fact that I was carrying so I was telling him how it is legal in the DMV so long as it is carried openly. I was just telling him about what happened last time I came to the DMV and was pulling out the laws when the DMV officer comes up and asks me if I'm carrying a gun.

Yes sir, I am.

He tells me I can't have a gun in the DMV, and I tell him I can legally do so. He tells me to show him the law that says so, so I hand him a copy of 202.3673 and tell him I'm not a permittee and I'm not carrying concealed.

He tells me I have to put my gun back in my car, so I tell him he'll have to arrest me.

He says, okay, come with me.

I say, can I grab my stuff first?

He says yes, so I'm grabbing my stuff and the guy I was talking to offers to be a witness, so I say sure and give him a piece of paper to write his name and contact information on. The officer is getting impatient, so I tell him I'll be there in just a moment.

I walk to the back room with him, and the lady there is telling him, "yep he's been here before, nothing we can do about it if it is carried openly." She asks me, "You were here before, right?" I say yes.

He tells me I shouldn't carry at the DMV because it scares people, I point at his gun, and I bring up the point that he's got a gun. He tells me he works there and its required. I asked him if he would bring it if it was optional, and he said no! I found that amusing. Anyway, I told him I like to carry my gun everywhere.

The lady says they can't make me put my gun away, but they can expedite me to the front of the line. I told her it wouldn't be fair to the other customers, but I'd do it if they wanted me to. She insisted. They escorted me to a desk. By the time we got out the number said #G123 on the screen, so I pointed out that my number was up next. So they waited the ten seconds for the number to switch over.

I did my transaction, (unwisely, I had filled out the form in pencil, so they made me fill it out again,) and then proceeded towards the photo booth and got my picture taken, and left.

Last time I came they wanted to expedite me too. It isn't fair for them to expedite us to the front of the line.

If you had no other reason to OC, being expedited at the DMV sounds like a great reason! Although I've been OC at DMV probably 4 or 5 times in both Henderson and W Flamingo and neither time was I offered such a reward for my patriotism.

Good info. I have to actually go there every year to register my Hummer because they can't seem to get it through there thick skulls that it's smog exempt untill they see the reg at the exemption office, maybe inspect it by looking out the window and write the little permission slip which has to be turned in at the time of reg. No checking it off in the computer or making a note of it. The first tiem I went to smog it the tech waived me off and out of line then told me they were exempt and to go to DMV. The tech knew but the DMV main office NOPE. I think after last years 2hr wait I WILL be OC.

This is good info. Great way of handling it. Thanks for sharing it. So many say it scares people. Too bad those could not have been with the group while we were at the Fremont Experience as we walked by hundreds of crowed people. No one gave a care. A few were surprised by all of the open carried firearms however did not move or run away, funny way of showing fear. I have open carried at the Pahrump DMV received great service not one comment on my firearm.

DMV = DOL(Dept of Licensing) here in Washington. I went in with my kids to get the "enhanced ID's & License." The DOL shares it facility with State Patrol office. While waiting a supervisor went and got a state patrol officer and pointed me out. His words "Its legal" and left. I was expedited to the front of the line to get me and my gun out of there.

Wow, just read the NRS-you're right! that damn security guard seemed like an idiot the first time I talked to him, I hate it when I am wrong on gun law.
Still, I would like to go with you there sometime and watch you do it before I do it. I'll do almost anything to get to the front of the line!

NRS 202.3673 applies ONLY to concealed weapon license holders, and then only to those CCW license holders who are carrying concealed (emphasis added below):

NRS 202.3673 Permittee authorized to carry concealed firearm while on premises of public building; exceptions; penalty.

1. Except as otherwise provided in subsections 2 and 3, a permittee may carry a concealed firearm while the permittee is on the premises of any public building.......

It does not apply to those without a CCW license, nor those with CCW licenses who are not presently carrying concealed.

Further, under NRS 244.364, NRS 268.418, and NRS 269.222, the State Legislature reserves for itself the sole authority to regulate (among other things, carry & possession) firearms in the state. The DMV has no authority to restrict the carry of weapons by non-CCW holders or CCW holders who are not carrying concealed.

Yep. I think we're all in agreement here about it - any policy they try to make about firearms not already a part of state law is arguably void.

And it's not like the DMV is a private business where the manager may choose to refuse service for any reason; a person's got no choice but to go there for anything more complicated than a tag renewal - so there's no operation in law to let them throw you out. Unless you're causing a disturbance (in which case, you'd just get arrested, and not thrown out anyway). Which peacefully & lawfully carrying OC isn't.

Have we discovered the magic way to skip the wait? Don't tell anybody; otherwise everybody would start carrying at the DMV ... :)

Yeah that was me. I never really read the law myself before I went in. So I didn't know that exact wordage to make an argument. But I know it now and will have it printed out the next time I have to stand in line. I have been in there a couple of time sense, but the was only to use the kiosk. A quick in and out. I will need to go in there soon to get a 30 day then reg. a vehicle I have, but I might wait till next year.
