OC'er kicked out of Big Lots in Milwaukee

From a reliable source (I'm not going to name names or say his vocation), but he told me police escorted an OC'er yesterday morning (11/27) around 8:30 AM at Big Lots in the 3rd police district.

I'll put in an open records request into that department tomorrow.

Even though I gave the time, date, and description of the issue, the lady said I had to give the address of which Big Lots. Time to jump through some hoops to find out which one.

WRONG!

You tell them you want all records regarding any interaction the police had at big lots within the last three days. Every Big lots in Milwaukee. They MUST comply and have about ten days to do so.

You want 911 calls, dispatch logs, police reports, emails, memos, everything having anything to do with OC and Big Lots within the last three days. If they refuse again, you immediately file a complaint with the DA.

Go get 'em!

I asked my friend about my call to make the open records request and he said sometimes they don't do their job. He didn't know if it was because they are lazy or if it was a department thing.

If they refuse, file the complaint with the DA and the DOJ. They CANNOT refuse the request AND, as Doug was fond of pointing out, the open records law HAS TEETH. $1000 fine for refusing.

I will make the same call tomorrow. I know the address, but that shouldn't matter, especially since I gave the time, day, location, description of what I was looking for.

Pardon my ignorance...Exactly what info is listed when an ORR is done ???

What records are released?? Other than the time,date...does it show who or wich officers reponded to the call ?? Is primarily the City PDs side or version of the story ??

If more than one officer, say for example 5 officers responded to a certain call would it show all 5 officers statements ??

LR, I had to do an ORR in Green Bay for an incident, what I got was a Transcript of the 911 call, ALL radio and "IM traffic" with an audio CD.
With that info I filed a non formal complaint against the LEO involved, since I have had NO issues in RE to me OC'n.
Prior to that, I had 2 contacts w/ GBPD. I will say this much, when their Shift LT and I talked, he understood what I knew, articulated myself well enough and no more "visits"
The audio CD was great, it got ALL radio traffic, officers call signs, the callers info, the whole 9yards.
It can cost a bit, however in my situation worth every penny!

When I submit a request I ask for any and all records including but not limited to (police reports, 911 calls, dispatch logs, video records, audio records, memos, emails, policies, witness statements, dispatch logs, etc).

They MUST give you everything, the more you ask for the more it can cost but it sure lets them know you are watching.

They can redact out some information like DL numbers, plate number, peoples SS#, address, stuff like that, but you still have to get all the records. If they fail to release them, then you go to the DA and the DOJ and file a complaint.

After you file the complaint with the local DA, then you take a copy of the complaint down to the local paper. (Police LOVE being on the front page saying they are being "investigated" for violating WI open records law /sarcasm).

I was told no to an ORR once because it was a case pending trial. Is that a fair way that they can reject the request?

I should mention it was for a criminal case. Perhaps there is a difference? It was an ORR about someone breaking into my friend's house while they were eatting dinner.

I would say NO. They cannot refuse, pending or not. They can redact witness statements but nothing more.

There is maybe one caveat, and it's a BIG maybe. If there is a robbery/rape/murder and the suspect is still at large, then maybe they can withhold SOME stuff.

Regarding a OC're being harassed, they better turn over EVERYTHING!

BTW: That is exactly what the anti's new plan is, to harass us into submission.
