    Post Interesting Negative Encounter with the Houston Fire Department

    So I'm buying fireworks from "Gorillas Fireworks" in Houston, AK for new years with a few of my buddies. I'm open carrying, these 2 fireman who were pacing the stands, just seemed to hover around us for a few mins, so we get are fireworks, and try to be on are way. Just as we hit the parking lot, 3 Fire Department trucks pull up, also the Fire Chef, We were thinking it was just the people shooting fireworks near the stands, but we were mistaken. The Fire Chef jumps out of his truck, and says "Who’s packing heat? Who’s got the gun?" now me and my buddies want to come back with some smartass comments, but we held are tongues. I told him it was me, then he asks how old I am, I tell him 19. He tries to tell me that its ageists "State Ordinance" to be openly carrying a gun, or own one at 19. I kindly tell him otherwise. By now there like 10 firemen around us, and someone from behind me tell me it’s against federal law, I told him in a not so polite matter that it’s only illegal to own one less than 18 years of age. They say they don't want to argue about law, I tell them I had read up on them, am I know the laws, and have also asked a crimal defense lawyer about these laws. Now the Fire chef is sweating, and faniely says I just want you to put it away. And I look at him and tell him I was already leaving when you stopped me.


    I'm thinking highly of writing a letter to the mayor of Houston, and I'm Very tempted to go to the Houston fire department with a LexusNexus Federal law, and State law book tomorrow, and show them the laws, I sadly left my phone in my car that had my federal law, and state law apps on it...

    What power of detention do they possess?
    If their job description does not include "harassment of law-abiding citizens" then walk away.

    And then write the mayor.

    Why FD and not PD in any event?

    I agree. This is blatant harassment by a non-law enforcement presence. This would have been out-of-line had it actually been from the Troopers or Houston police, much less than from firefighters.

    Aren't they volunteers in that area? This is outrageous.

    I agree - WAAAAY out of line, for all the officials involved. See if your friends will write letters too, or maybe you want to send one signed by the whole group.

    I'm going to suggest getting someone to proofread your letter before you send it, so it's more understandable & makes a better impression.

    We were buying like $500 bucks worth of fireworks. So, I think they just wanted to harassment me and my buddy's, what I don't understand is why they would even bother me about it since we weren't causing any trouble, just standing in line. I'm gonna write the letter tomorrow and maybe drive down there, and kindly give the state laws, to the FD so they can read over them. I just hate how ignorant people can be. I'm still ticked at my self for leaving my cell phone in my car, couldn't record it or anything.

    And they "responded" to your location, then "skidded up" in a "couple more fire trucks" ????

    I would have LOVED to see this incident.

    You shoulda ignored them like they were rocks in the parking lot.
    They have DOODLY-SQUAT for "authority" to even question you about a firearm.

    I just WISH one of my guys would try a stunt like this.
    I would "allow them" to do hose drills in FULL TURNOUT til their butts sucked buttermilk.
    What part of "SHALL NOT BE INFRINGED" is so hard to understand ???

    Im confused, were you in Houston, Texas? If so, open carrying a rifle is not illegal. The only issue with that law is the word " Alarm".. Thats a libtard word that allows LE to screw with you for doing nothing wrong!

    Not meaning to argue with you Butch, but many localities require fire fighters to drive their firetrucks whenever they leave the station for any reason (such as going to the grocery store for food) because they can leave directly from wherever they are to a fire instead of going back to the station house and then driving to wherever the fire is.


    Admittedly, they don't often go car shopping with the ladder trucks, though.

    Interesting, I was unaware that firefighters took an oath to uphold the Constitution, perhaps you could provide a citation? Or perhaps a quote from somewhere in the internet?

    A sample Fireman's Oath:
    "My duty is to protect those that I serve from whatever danger they may face; whether it be fire, demon, or angel; no matter the danger, I will protect the people to the best of my ability. I am but a servitor of the people; my duty is to those who I serve, and to no one else. I serve The People, without fear, without remorse, without fail. My Duty is to The People. By my Fireman's Oath, I am bound to protect those who are in danger, those in times of need, those who I would serve."


    Again, I'm not trying to defend their action, I am only attempting to clarify why they used publicly owned equipment while doing what they did.

    Alaska has the best firearm laws lol... why would the fire chief even be concerned? I know that firearms have the word 'fire' in them, but they do not need to be put out lol.
    Now fire marshals/investigators have law enforcement powers, but you didn't say it was a fire marshal so I have no idea why they would be concerned.

    You weren't trying to ignite things with your firearm were you lol. Yeah that's weird.

    Outf***ingstanding. MWAG on the FD channel, and the whole department responds, thus validating the original poster's need for a firearm -- when faced with individuals who would violate his rights through overwhelming physical force.

    I'd do more than just chew on the chief about this one.

    Absolutely write a letter & hand deliver it looking the part of an adult.... Give it to the FD, police & City/County council they are under. That's BS..

    As a firefighter, that ticks me off. The only way I see them having jurisdiction in the matter, is IF they are a Public Safety Dept. There are departments where FFs are crossed trained as LEO. They switch from side to side.
    OR
    They were Fire Marshals with LE powers. Some departments across the country give LE powers and/or a pistol to their Fire Marshals.

    Sounds like the fireworks stand was run by some firefighters, who called their buddies when you showed up with a gun on your hip. They don't know the law, so they thought you were trouble, because "everyone knows its illegal to carry a gun." The guys came down in a show of force, since the cops take forever to get anywhere. Now, had you been trouble, the town would need a new fire department, not just a couple of new guys. Just a thought.

    In Las Vegas, I believe it was Chicago visiting fire fighters told one of the open carry posters it was not legal to open carry. They were told nope your are incorrect. Long story short they call 911 with the gun owner standing there. After the 911 operator educated the fire fighter caller, they said they would never come to Las Vegas again if it was that out of control. Looks like there are a few cities that will be able to close up their police departments because their fire department has them covered.

    The city of Houston is a JOKE. They mayor has been up for recall. Has suspended two police officers cause they called the mayor to the carpet. I avoid that area when ever possible.....

    if a group of firemen responded, and surrounded you, then began interpeting the law to you, you must have been detained by them. apparently they now have police authority, but little intelegence when it comes to the law.
