GRNC Alert 4-3-11:
Bureaucrats Quietly Attack Your Rights

Unknown to gun rights advocates, a collection of bureaucrats and state attorneys general this weekend continued their quiet effort to hamstring gun rights groups. The group is the "Uniform Law Commission;" its mission is to promulgate "uniform" state laws, and it is the same organ that gave us state-level gun control in the form of the Uniform Firearms Acts of 1926 and 1930.

COMING SOON TO A STATE NEAR YOU?

Euphemistically described as "protecting charitable assets," what they are up to now is crafting model legislation for adoption by states which could require non-profit organizations - including gun rights groups - to:

* Register with any state in which it does business or holds assets; and
* File reports with those states, including a confusing array of "reportable events.

SHUT DOWN BY GUN CONTROL ADVOCATES?

Worse, it would give gun control groups the chance to harass gun rights groups - even to the point of driving them out of business. How? By filing complaints with an Attorney General, who could then begin an investigation if he "has reason to believe" it is necessary. Note that "reason to believe" is an absurdly low burden of proof, and the resulting investigation could even result in the AG subpoenaing membership lists of organizations.

Lest you consider that hazard only theoretical, understand that lawyers from North Carolinians "Against Gun Violence" have already filed bogus complaints against the GRNC Political Victory Fund, at one point even falsely claiming to reporters that the Attorney General was investigating.

Although members of the commission responded to gun rights advocates at the meeting, their concessions are far too limited to protect civil liberties groups.

Members of the Uniform Law Commission:

Ostensibly directed toward abuse of laws governing charities, the so-called "Protection of Charitable Assets Act" (POCAA) will hamstring organizations devoted to preserving civil liberties, including Second Amendment organizations, by miring them in interminable registration and reporting requirements, and by subjecting them to abusive investigations by Attorneys General who respond to trumped up complaints by opposing groups. Narrowly crafted "carve-outs" by the committee are grossly inadequate.

Worse, gun-related groups could be required to register assets - including firearms. If adopted by states, the net result will be a system rife with abuse which suppresses free speech in the furtherance of individual freedom.

Laws already exist to prosecute those who abuse charities. The POCAA is bureaucracy at its worst. If you don't kill this proposal immediately, rest assured that gun rights organizations, teamed with other civil liberty advocates, will do so in any state where it is introduced.
