Illinois General Assembly to Pass HB0148 - Family and Personal Protection (Shall-Issue Concealed Carry) Act!!

The bill has NOT been called to a full house vote yet, but the subject of this email really is something you could read in the newspaper this month!! Concealed Carry has a real chance to pass NOW. But we need everybody reading this email to act NOW.

Quick summary of progress:

1. Illinois House Bill 0148 has passed out of committee and is waiting to be called to a full vote on the house floor.
2. The bill nearly has the 71 votes needed to override a veto - if Gov. Quinn does veto a bill that goes to his desk.
3. The Illinois Sheriff's Association has click here concealed carry by unanimous vote
4. The Illinois Association of Chiefs of Police has officially supported concealed carry.
5. The Chicago Police Lieutenants Association has officially supported (you must be logged-in to ICarry.org with your user account to view this link) concealed carry.
6. The Chicago Police Sergeants Association has officially supported concealed carry.
7. The Illinois Farm Bureau has resolved to support concealed carry legislation in Illinois.
8. The US Supreme Court has affirmed what we already knew - the right to keep AND bear a firearm is a fundamental right. This makes Illinois' laws that completely prohibit bearing arms unconstitutional!!!
9. Multiple "open carry" events were held on private property in Illinois in 2010. 2011 will bring even more!!

Lets hope the Doyle holdovers that infest the Wisconsin LRB don't look at this for "model" language.

That's good stuff, - especially with Blains having stores there - but they went nuts with requirements to get a permit.

Unfortunately, that language will not be in the final version of the bill. It was removed so the business organizations would not oppose the bill.

It would have been a better provision if the language was worded to provide a liability immunity for businesses that allow defensive arms as opposed to statutory liability if they do not.

The version of HB0148 posted on the ILGA website is not the final version. The final version will most likely have a library ban and a few tweaks involving live fire qualification required for renewal. Some of that was required to get the chiefs on board.

Following is the status calendar of HBO 148 There is no record of an amendment to remove the words Dave Gran posted. The only amendment to date 3/31 concerns carry in libraries. The third reading was scheduled 3/31 but no post has been made on the result of the reading. I am not familiar with the Illinois General Assembly process but I would expect that at such a late stage of the game any removal of language would have to be in the form of an amendment and subsequent floor vote. The next session of the assembly is Aprill 11 so perhaps more info may be forthcoming.

When is Wisconsin going to get a carry bill?

According to the legislative calendar for 2011 there are three times that non-budget bills are scheduled to be sent to the governor. March 24, Aug 4, Dec 8. March 24 has already passed with no action on a carry bill. Aug 4 will include bills passed by both houses of the legislature between Mar 24 and July 29. The next bills sent to the governor for signing on Dec 4 will be those non-budget bills passed between July 29 and Nov 3.

The earliest we can expect to have a governor signed carry bill is Aug 4. If the republicans hold to their promises to pass a bill this year it could be as late as Dec 8 before one hits the governor's desk. I would guess it will be Aug 4. It will probably be mid May before we see any drafts.

I have been in this "carry" fight since 2003. A couple more months is a walk in the park.

I do not believe the bill will change substantially from the version w/amendments passed, but if the sponsor allows the bill for a floor vote then you know the verbiage of the bill listed on the site is the bill voted upon. Assuming no further amendments are adopted which will require another reading. If the bill is not allowed by the sponsor, there may be further work required on the language. Either way signals the bills support that day is not favorable for passage. There are very few up or down votes in the house where the outcome is not already known. This just might be one of them.

One thing to remember about HB0148 is that the bill contains full preemption of local control and therefore the chair has consistently applied the 3/5ths rule on passage. In other words, anti-gun bills only require a simple majority. Pro-gun votes requite a super majority. In the house that is 71 votes.
