Evers’ Second Amendment Protection Legislation Heads to the Governor
Legislation Wins Support of Both Chambers of the Legislature, Waiting for Governor’s Signature
Tallahassee, FL — Senate Bill 432, which passed as House Bill 155, was approved by the full Senate today and will now head to Governor Scott for his signature. This legislation provides that the ability to question patients about firearms is only allowed if the medical care practitioner, Emergency Medical Technician or paramedic believes in good faith that the information is necessary to the patient’s medical care or safety or the safety of others.
“This bill represents a compromise between the NRA and FMA, and I believe is in the best interest of Floridians,” said bill sponsor Senator Greg Evers. “Citizens have a right to have a gun at home, and they have a right to be private about it. If it is irrelevant to their medical care or their reason for visiting their physician, they should not be questioned about gun ownership."
The bill also provides that the patient has the right to decline to answer any question regarding gun ownership if practitioners deem it necessary to the patient’s care, and practitioners must respect and honor this right. The bill also provides that no information about gun ownership may be entered into the patient’s medical records if it is not relevant to medical care or safety. Further, any violations of the provisions defined by this bill will be grounds for disciplinary action by the Board of Medicine.
Senator Evers currently represents Florida Senate District 2, which include parts of Escambia, Okaloosa, Santa Rosa, Washington, Bay, and Holmes counties. Previously, Senator Evers served in the House of Representatives, representing Florida House District 1, which includes parts of Escambia, Santa Rosa and Okaloosa Counties. He is a farmer and small businessman who was elected to the Florida House of Representatives in 2001, was subsequently re-elected, and elected to the Florida Senate in 2010. Evers has put his experience in agriculture and business to good use in the Florida Legislature and is proud of his legislative accomplishments on behalf of Florida’s critical agriculture industry, economic development and job creation, and Second Amendment issues.
