Legal Fund for Appeal of SBE found guilty for legally carrying a firearm

Law abiding citizen legally carried a firearm openly. Off-duty Jacksonville, AL cop, acting as security, had Mr. Shortbuseinstein (screen name on alabamaopencarry.com) arrested for a section of Alabama code 13A-11-52, which reads "Except as otherwise provided in this article, no person shall carry a pistol about his person on premises not his own or under his control..."

Jacksonville judge admits the law was confusing, but found SBE guilty anyway. By their reading of the law, no one in Alabama would be able to carry anywhere except his/her property. The city (which has no legal authority to make its own gun laws due to preemption) has ruled that common people are not allowed to carry onto premises not your own, even with a pistol license. Of course, this is not the intent of the law. The United States Constitution, the Alabama Constitution, several court cases, and several attorney general's opinions have stated clearly that you can carry onto property not your own, including carrying openly without a pistol license.

This is a grave injustice that an innocent man has been found guilty for exercising his right to keep and bear arms for the protection of himself and others. Our legal system is supposed to work for the people, but more and more it is working against the people. Please join this fight for the rights of an innocent man as well as the rights of every man and woman.

SBE has suffered much loss and possible embarrassment, and this decision must be reversed. It takes money (that he does not have) to fight it. Please donate whatever you can, big or small; it all adds up and will be used to fight injustice. If there is money left over, it can be used to right this wrong in civil court or help another victim in criminal court.

§ 13A-11-52. Carrying pistol on premises not his own; who may carry
pistol.
Except as otherwise provided in this article, no person shall carry a pistol about his
person on premises not his own or under his control; but this section shall not apply to
any sheriff or his deputy or police officer of an incorporated town or city in the lawful
discharge of the duties of his office, or to United States marshal or his deputies, rural free
delivery mail carriers in the discharge of their duties as such, bonded constables in the
discharge of their duties as such, conductors, railway mail clerks and express messengers
in the discharge of their duties.

If this decision is not reversed on appeal or the law is not changed, the case will set a precedence where no one in Alabama will be able to protect himself or his family, except on his own property. You won't even be able to go to the range to practice unless you own it.
