We are now running on a new, and hopefully much-improved, server. In addition we are also on new forum software. Any move entails a lot of technical details and I suspect we will encounter a few issues as the new server goes live. Please be patient with us. California ONLY please.... Is Open Carry legal while working as a repossession agent?

From my experiences with "repo men" (none of whom were after me), I would advise you to move out of California and get an honest job.

Welcome to OCDO. I'm guessing you came here because of the UOC (unloaded open carry) restrictions you will be facing in your work AO. Nice to know the search engines think so highly of this place.:lol:
I seriously suggest you consult an attorney on this one. From what little I know about the repo business you need to have more than just a drivers license and a willingness to do the job to do it. That being said, if you violate some provision of the permitting/license rules you risk not only your current job but your ability to be employed in many fields beyond what a criminal record itself would do.
But stick around. You will most likely meet some good folks and you will have a chance to both learn and contribute.

Yup get mods to move your thread~~I am not sure about CA but some states have reserve deputies, or special deputies. Check with your sheriffs office on that. If they do you will have to sacrifice some time each month to serve the dept for a commission that will allow you to carry.
Nothing's wrong with you job except that just about 99.9% of the people you meet hate you for doing it.
Unless there is someone else working repo in California who has all the dope on both general firearms laws and any special licensing/permitting for repo work, you are going to be a lot better off consulting an attorney. Many of them offer free consultations.

I'll admit, California is pretty lame as far as gun laws, but what's wrong with my job?
The only reason I put this in the "open carry questions" instead of the "california" section, is because under each state, it says for example "California Open Carry Stories" so I didn't want to post a question where you're just supposed to put stories or whatnot....

My friend before I carried in the Great Socialist Republik of Cali, especialy in your line of work, I would darn sure consult a laywer. The internet is a great place to exchange ideas and comments, BUT, before I jumped off into an endevor that I could wind up in jail for firearms charges, I'd personally check with a lawyer.

In CA, we have GFSZ(gun free school zones) which we must stay 1000 feet away from at all times. Kind of hard to do in the repo business I would think.
There is also business codes that require you not to threaten the owners, as I am sure you are aware of. If you were UOC, they could infact say you were threatening them, and you would not only loose your license, but also find out what the inside a jail looks like.
my advice is not to OC while on duty. Use what is called LUCC- locked unloaded concealed carry. where the gun is unloaded, and locked in a secured container. Left inside the truck, to be used only as a last result.
Carry pepper spray, and a taser.

Nothing is wrong with your job! It is not your fault people don't pay their bills or try to work something out with the bank. There is a reason cars get repossesion orders. Somebody has to do the dirty work!! I agree with the others who say to consult a lawyer. It is such a technical question it might be difficult to get an accurate answer on the forum. Good luck!
I looked around in the various California codes, but couldn't find anything regarding repossession and firearms. The only thing I found related to both these things was in the Business and Professions Code section 7500. There was a code on how repo workers should turn in firearms to police (7507.9(b)(1)), and there was a code on a repo worker being disqualified from working in that field if there had been a charge relating to illegal possession of firearms by the worker (7510.1(d)).

I am familiar the business and know that it would be extremely rare to be brandished upon. In such a rare circumstance it only makes sense to back away and dial 911 since their objective is to continue to posses the ride, not to harm you. Get your hook up after the cops arrive since they may be arrested if they continue to view you through the sights after you have identified yourself.

+1,000 on knowing the stipulations on your licensing. I would not be surprised if your insurance would disqualify you for possessing a firearm while in the exercise of business. Definitely check with a lawyer who knows your line of work and understands that CA law does not restrict you from carrying (in line with the law) during the course of your business.

You don't need to stay "1,000 feet away" from the GFSZ.
You have to stay out of the GFSZ which extends 1,000 feet from school property.
The way you stated it we would have to stay 2,000 feet away from school property to be 1,000 feet away from the GFSZ.
So you would draw an unloaded gun on someone who has already drawn on you with very likely a loaded one. And you're not dumb. Interesting...

As a former Repo man, I do know that in California an agent can not carry weapons of any kind. Not even pepper spray. We had a agent get arrested for having a tire club(for checking the trucks tires) in the cab with him(judge dismissed the case). Unfortunately, i dont remember the actual laws regarding agents. A secret, keep a big tool near you, but make sure it fits a part of your truck.
