Spokane Valley adult home loses license over guns

SPOKANE, Wash. — The state Department of Social and Health Services has revoked the license of a Spokane Valley adult family home because the caregiver carries a pistol and keeps a shotgun locked up in his room.
The state agency told KREM ( http://bit.ly/n1ul53) the issue is not gun rights, but the safety of six elderly residents.
Police escorted DSHS investigators on an Aug. 29 inspection of the Valley Pines Retirement Home.
Home operator Spencer Lowell says he has the proper permits to carry a pistol and has violated no laws. He says he locks the pistol up at night with the shotgun.
The license revocation is being appealed through administrative hearings.

Why do they have the right to take away his business for safety reasons? But you can walk into almost any Gun shop and they are always carrying for the same reason. and the state doesn't close them down!!! Just another way for the socialist to take control of just one more more little piece of our way of life.

Sounds really ridiculous. Where are the old folks going to live if they have to leave this place? Bet the state hasn't thought about that. Wouldn't the residents be SAFER because their caretaker is armed?

They had a very good interview with the home owner/operator on KREM Spokane Channel 2 last night. The owner carrys, and owns a shot gun. The shotgun is locked up in a safe, in his room, in a closet. The owner carries all day, and locks up his pistol at night>(why would he do that?)\\anyway, that is what was said.

DSHS regulations say that firearms must be "accessable only to authorized persons". Sounds to me that there must be a new very strongly anti-gun case worker involved...when they (I am going to call it a raid) raided the home, the DSHS representative brought armed Local law enforcement with her. (don't remember if they said 2 or 3, but the video only showed one LEO)

The Home owner/operator also stated that he had been inspected before, and the presence of the firearms was not in contention on the previous visits.

The owner/operator has filed an appeal with DSHS. It will be interesting what comes of the appeal.

This is stupid. There is a shortage of adult homes for those who need care. There are many out there who are abusive towards their patients and don't care about them. Here we have a caregiver who had his license taken away to care for of vulnerable adults not because of the above issues I mentioned but for having guns in the house, all of which seem to be properly stored and safely handled.

Amazing the State does not act quickly on abuses of nursing homes and these adult homes as well with over medicating and abuse but let someone be prepared to protect himself and those in his home then all they go crazy on something as this.

How many children and adults have died in Washington State while under the care and supervision of DSHS in situations that involved firearms? I haven't read of any but I've read of far too many where they have been beaten, starved, and even burned to death by another "resident" of a DSHS supervised home setting fire to it.

Guns are the least of DSHS' problem. Lack of intelligence seems to be high on the list of DSHS problems.

Well wouldn't be a problem if we didn't allow the state to regulate and license everything. This should be a private matter between private individuals.

Did they even think to ask the residents what they thought or how they felt?

Unfortunately this is an example of why one should have a lawyer on call. Especially when dealing with the State.

At first contact I would have said "nothing further will be said until our lawyer arrives.

If all is as was described in the "narrative" that same lawyer should now be filing lawsuits.

Isn't amazing how law enforcement is so adept at intimidating people to consent to searches. The most important lesson people need to learn is "KEEP YOUR MOUTH SHUT".

Welcome to the forum though I am horrified for the reason for your visit.

I am going to assume that your many hours of firearms training never dealt with "How to deal with your government when it shows up in your life unasked for and unannounced." Welcome to the real world. This will be a painful lesson on the overreach of unchallenged power.

Your state provided civics education will not be up to the task of righting this wrong or even challenging the machine in Olympia. You will need the services of a good lawyer and you will need to educate yourself on YOUR RIGHTS for the future. Notably the correct use of your Fifth Amendment Right to keep quiet.

Everyone should carry a 12" piece of "Duck Tape". If you don't need it to keep your mouth closed you can use it to fasten you pistol or spare mag to your forehead

I worded my post poorly, I was referring to the cops and their coercive tactics at getting people to talk.

Although the more you are approached the easier it becomes at becoming adept at exercising your rights and the greater the satisfaction in staying firm against coercion.
