    Statement from Attorney General J.B. Van Hollen on Suspension of Concealed Carry Training Requirements

    By law, the Joint Committee on Review of Administrative Rules (“JCRAR”) may suspend a rule or part of a rule if it determines that certain criteria have been met. Pursuant to that authority, JCRAR has voted to suspend certain portions of the Department of Justice's (“DOJ's”) emergency rule on concealed carry that define how applicants may satisfy the training requirement, including the requirement that a “firearms safety or training course” include at least four hours of instruction.

    The Department of Justice (“DOJ”) will immediately begin processing all applications for a concealed carry license without reference to the suspended portions of the rule, including applications that were sent or received prior to JCRAR's action. Applicants may continue using the application form provided by DOJ until a revised form is made available. However, during the period of suspension, DOJ will not enforce the suspended provisions and will not reject any applications for failure to satisfy the requirements set forth in the suspended provisions.

    Unfortunately they did not strike 'face to face' so any internet only course is still out.

    All of us on opencarry.org should be proud of this accomplishment. It says loud and clear: The legislature respects us. The legislature realizes that we have real power. Push for Constitutional Carry for next year. Support those who have supported us with this legislation.

    There is no mention of "face to face": in the JCRAR's memo. It only says 'instuctor led". That doesn't mean the instructor and student have to be face to face. Many on-line college courses are remotely instructor led via the internet.

    Is this now permanent? There is nothing JB or anyone else can do to reverse or appeal this right?

    I *think* the rules in place are still considered emergency rules and will be up for the normal review/change process. Once that's done, things will be finalized. Someone correct me if I'm wrong here.

    The Joint Committee for the Review of Administrative Rules (JCRAR) passed a motion to suspend some provisions of Emergency Administrative Rule 1114. effective Nov. 7, 2011.

    4 pieces of information that had been on the proof of training certificate, are no longer required.

    Jus 17.05(2): Except as otherwise provided in sub. (1), for purposes of satisfying the requirements of sub. (1)(b), (c), (d), (e), (f), or (g), a certificate or affidavit documenting that the applicant has successfully completed a firearms safety or training course must include all of the following information:

    (a) The applicant’s name.

    (b) The name of the firearms safety or training course.

    [Strikeout] (c) The length in hours of the firearms safety or training course.

    (d) The date on which the applicant completed the firearms safety or training course.

    [Strikeout] (e) The city and state in which the applicant completed the firearms safety or training course.

    [Strikeout] (f) The name, address, and telephone number of the person or entity responsible for the firearms safety or training course. This may be an individual instructor, a national or state organization, a law enforcement agency, an educational institution, a firearms training school, or another public or private institution or organization.

    (g) The name of the instructor who taught the firearms safety or training course to the applicant and the name of the agency or organization that certified the instructor.

    [Strikeout] (h) A signed statement by the instructor who taught the firearms safety or training course to the applicant affirming that the course satisfied the definition of a firearms safety or training course in s. Jus 17.03(8) and that the applicant successfully completed the course. An affirmation that the applicant merely attended the course is not sufficient to satisfy this requirement.
    It struck out the "at least four hours of" for training. It left in that the training be instructor-led.

    It struck out the clause that put a minimum on instructor training: "that requires firearms instructors to sucessfully complete instructor training of at least eight hours in length;"

    No changes for those who fulfill the training requirement with:

    Hunter Safety education.

    Current or Expired firearm carry permit or license.

    Your conclusion is incorrect.

    The JCRAR just mentioned what has been changed or removed. The rules still contain the definition of Instructor-led:

    JUS 17.03 (9) “Instructor-led” means training that is conducted face-to-face in which instructors actively guide students through each lesson, answer questions, facilitate discussion, and provide feedback on activities and/or assignments. Learner-led or self-directed learning—the delivery of learning experiences to independent learners who lead and manage their own experience, delivered via web pages, multimedia presentations, computer applications, online presentations, or similar methods—is not instructor-led.
